-how much you have paid so far

-whether these are internet or storefront lenders

These people are storefront and the amount is $150 with penalties its $197 and its called checksmart

Checksmart is a hard company to deal with b/c they won't accept payment arrangements or anything. How long have you been in default with this company? I'm going through the same situation myself with their corporate office. Usually it is a civil matter, but a bankruptcy attorney had just told me not too long ago that if a storefront can prove criminal intent such as putting a stop payment on the check or closing your account, then they could pursue criminal charges for "passing a bad check."

i would check your state laws and make sure they are following the law. just because they are a storefront doesnt mean they arent breaking the law

This sounds like an ipdl, am I correct? That is just a threat they are giving you just to try and get you to pay up. Don't worry about that threat, it won't happen. But if it is a storefront, they can and will take you to civil court if some type of arrangement isn't made. Majority of storefronts in OH do follow the laws. And if they are saying they can charge you with a crime, they aren't making an illegal threat, in OH under certain circumstances you can have charges filed against you for defaulting on a storefront pdl if certain conditions exist. Internet pdls can not do anything because they aren't licensed. The only licensed internet pdl in OH is CashNetUSA.

yacoub - are you the same as the original poster - ba1442? Steelers - I don't see a reference to the name "checksmart" being licensed on the Ohio state website - have you searched on them? You would know more about those laws and who is licensed there. Have you heard of this company, either storefront or IPDL?

Checksmart is the dba for Buckeye Check Casing, their license was renewed 11/17/06.

Checksmart and Express Payroll Advance are dba's for Buckeye Check Cashing and they are licensed in OH. The # for their corporate office for collections that handles both stores is (866)354-0567.
