Default Is this Illegal?

Company/Individual reported: Palasiades Collection/Spiegel

They have posted a debt that is closed and over 7 years old on my credit report. I have never heard of this collection agency. Never received any documentation from them. Can they do this when the debt is scheduled to be removed under law?

I seem to have your same problem, "Anonymous". I believe that Palasiades (sp?) is also the same company as Paragon Way, and I have them listed on my Experian report as collecting on an old debt that has passed the Statute of Limitations (sol). Which state did you live in when you opened your credit line with Spiegel? Each state has different laws pertaining to sol. I lived in California when my debt was opened, and California's sol is 4 years for written contracts (and 2 years for verbal contracts).

Default Automatic deduction from checking accout

I have never authorized for Capital one to deduct any payments from my checking account, the account is closed and the bank is charging me with over draft fees. I have called and asked Capital One to stop doing this but they continue to do it. I HOPE THAT I AM SAYING IT LOUD ENOUGH STOP TAKING THE PAYMENTS OUT OF MY CLOSED ACCOUNT!!!!!!!!!
