I took out a c ashadvance in the amount of $600 with cashin30minutes.com i lost my job and wasnt able to pay the loan back i got a call from a guy name brad with National Attorney collection services sayin that i have a LEGAL CASE IN THERE OFFICE AND IF I DONT PAY 720.00 IMMEADIATLY i was goin to be charged wit check fraud and would get 2years probation and would have to take some type of classes at the time i took out the advanvce i was living in delaware .could i really go to jail or be charged with a crime please help me im terrified

Sounds like more scare tactics to me. You aren't going to jail for defaulting on a loan. That's a civil matter, not a criminal matter. Please post the following information, the amount borrowed, amount paid back, the state you live in and whether this is an internet or store front loan, then I am sure someone can help you out and give you some advice. Smile

"No criminal action can be taken against the consumer due to nonpayment of outstanding amount or, unpaid return check or automated clearing house transaction. Lender can collect reasonable collection cost or attorney’s fees, provided these additional charges are mentioned in the agreement paper."

This is from the Delaware law section. You will not go to jail or be charged with check fraud. Lenders do need to be licensed in order to lend money, even online. I do not know off the top of my head whether cash in 30 minutes in legal but due to the fact that they threatened you like that I would guess that they are not.

keep track of everything the collection agency says to you and write names, times ect. What they are doing is against federal collection practice laws and you could sue them for this behavior. Make them validate your loans. Someone should be along to give you detailed information on what to do.

What is a debt validation letter?

It is a letter requesting that the collection agency send you in writing a validation that you owe a debt. If you send them the validation letter ( which someone here can pm you or post here) they must stop harrassing you and validate that they own the debt and that it is a legal debt. My guess is it is not a legal debt and once you ask them to validate it they might just go away, some others here have had that experience.
