Hey...I just got a call for my husband from Capitol Collections saying he was involved with a case he probably knew nothing about and of course it is probably over one of these PDL companies...but they said it was a *case*? Like it was him specifically.
The number they gave was 1-800-973-5402...can they come after him for this? Or can they even contact him?

Nope...and they asked to speak with my husband specifically...that they could not talk to anyone else about it....said that they did not know if he knew he was involved with this or not?
I got the call for him and was worried it was about something else then called as a *family member* and told them I knew of no case he was involved with? They said, "Oh he is involved with this one."

If it is about you and they tell him what the "case" is about, big time FDCPA violation.

ahhhh...stupid, stupid here...in my name or my husbands?
They never said who they represented either...just that they need to talk to him....would not tell me as a family member. Perhaps they are trying to get to him to get to me?

Try this...wait a few more days. By law, they are supposed to send something in writing no later than 5-days after the first call. See if they send anything and/or keep calling....
If you dont get anything in writing, send them a letter, in your husbands name that references the ph# that they have been calling.

Its a scare tactic. I had a company about 5 years ago leave messages on my phone saying they had a "case" against me and i needed to call them within 24 hours before I had to go to court. I never received anything in the mail. It is against the fair debt collection act that they "scare" you with cases and court w/o notifying you via mail that they are suing you etc.... well, I found a cool lawyer ona website and he helped me send them a letter saying we were suing them for $8K for harrassment and not applying with debt collection acts.... they countered that they were dropping any actions and would eat the $1K I apparently owed them.
