I contacted impact cash the same way i contacted all other loans I had once I found out it was illegal. They actually emailed me back today! Less than 3 days (business) from the day I sent them a fax and e-mail. And here is the reply:

We are sorry to hear you have not been satisfied with your experience with Impact Cash USA. We have reviewed your loan with us and we are willing to mark the account as settled. We will not attempt any further drafts from your account. Please let us know if you have any questions.

Emily,

Thank you for your prompt reply to my inquiry. I took 2 loans with Impact, totaling $650. I paid $2035 dollars. By New York State law, I overpaid on my account with Impact by $1,385 and I am entitled to a refund back. I can provide information based on my bank account for the amount of my loans versus the amount debited from my account. All I was obliged to pay was the principal loan according to New York Law, none of the refinance fees were legal and I will pursue action if not granted a refund.

Who would I need to speak to in regards to refunding my money?

You need to contact your state DFI or AG for further help. You can also draft a letter stating the amounts paid and the total refund you are entitled to sending it to the PDL company directly. *FYI* PDLs are ILLEGAL in NY period! Best of luck Smile

OMG They replied right away!

You have actually taken out 5 loans with our company, which included 3 previous loans which were paid 2 years ago. We will settle with you at the principal amount of each loan, as well as the fee for processing and funding the loans. The amount we are willing to refund to you to settle this matter is $878.50 The most current checking account information we have for you is with Wachovia bank. Please let us know if this is the account you would like the funds deposited as soon as possible so we may start the process. Let us know if you have any further questions.

Dude! I CANNOT BELIEVE THEY ARE REFUNDING ME!

Omg I'm so happy I just had to close my office door and do a happy dance!!!!

It's amazing what can get accomplished when you threaten legal action Very Happy

Persistence pays off trust me. I got 6 refunds from my PDLS within 2 months. So I know it is POSSIBLE. GOOD FOR YOU! Very Happy

I really owe it to everyone on this board. I had NO idea that these were illegal or what actions to take until I came here. I cannot begin to tell you all how appreciative I am of all the help I found here. If you were all New Yorkers I'd take you guys out for a drink as a thank you !!!!

I'd never have gotten out of this mess or even gotten refunds if it wasn't for this forum Smile
