I got this email today and I was wondering if this is even legal to take money from a checking account I have at a totally different bank. I am in Illinois and if you could direct me to something official (i.e. an actual law or something) it would be greatly appreciated. Thanks, I have tried to use the search function but it isn't working.

History: I refused to pay these people after they were making my payments twice what I agreed and when this guy said "oh you live at (insert address), i know how to handle you".

Please register on this site and you will get numerous responses to your question. Report them to your local BBB office and the BBB in Missouri as they are part of sister companies known as DMS Mktg, Loan Shoppe, Xpress Cash, Mount Oread Ventures II, and various other names, your local AG's office and the AG's office in the state that the loan company is located in. If it's in Missouri for example notify them. As long as you have paid them back what you legally owe, then you owe them nothing.

I am pretty sure that they are probably operating illegally in your state, but to be on the safe side refer to your banking department. Someone will be along to give you more information on what steps to take from here. I am not even sure they are licensed to loan money anywhere to tell you the truth.

mindy, do a google search on this site and type in Check Recovery or Westbury Ventures. You will see all kinds of posts regarding these people and their tactics.

I just googled Check Recovery, and it is infact a business that collects NSF and ACH transactions. It does not clarify, uf they actually go into a data base and find your new info. If this is true it is very scary. Things like this upset me. If someone comes along who knows about this, please post your thoughts

Tell them that that would constitue wire fraud. no one can do an electronic deduction from your bank account without your permission. They are lying. If they were able to get your new bank info and do an fraudulent check to withdraw funds, you bank would HAVE to put the money back once you told them the withdrawal was fradulent.

I registered for the site and am currently trying to find some information on this. I have saved the other 27 (literally) emails this guy sent after I basically told him i was calling the cops if he called me again.

Stuff like this really scares me. Like i said, there is a real company called check recovery. I googled them.
My convern lies in the fact that they mention a bank data base that is available to find all your new banking info. Can this be ????

Yes it is Westbury Ventures or at least that is how he signs off on his emails. But if you look at his email addy its under LTS management.

Is there a way to see if the company is licensed to lend in my state or at all? I tried the IL secretary of state but with this place having so many names I don't know how to do it.

They won't be able to get your account info from any reporting agency. What they can get is what bank you may have opened an account at - Because if that bank checked that report then it will show as an inquiry.

But this is mainly a scare tactic used to try to get you to pay up. Do not worry about them getting your new account info. If you are careful and do not take out any mroe pdl's with the new account your chances of getting the new account hit are like .001%. Not really worth worrying about.

I agree with goudah2424 it is just a scare tactic. DO NOT, AND I REPEAT DO NOT TAKE OUT ANOTHER PDL as they more than likely share information with each other. They pulled this one on me and I talked to my state's legal aide and they said that they can not legally deduct any money from your account, besides the fact they would need to know what bank you are at and a routing and account number. Do not worry about it.

mrhender, I did a google search on lts management. It's on ripoffreport.com along with Westbury Ventures and DMS Marketing. Maybe that will make you feel better. It's not a reputable company. Just one of the "nasty" ones that like to threaten people and try to scare them.

So Cannr, The company Check Recovery can not find your new bank info. I am uneasy about that bank data base thing. Do you think that there is some sort of data base that will give out all our new bank info?

Like goudah's post says, the chances of them finding your brand new account are really close to "none". Plus the fact that, even if they did, you would really have claim to file fraud charges. You certainly aren't authorizing anyone to debit that bank account! But, I'm personally not concerned with it. However, if I get hit, I'll be on here having a fit! LOL! Laughing I think they say this stuff and use the "names" to scare the crap out of people. And, see? It's working! kash, I honestly wouldn't even let it concern me. I look at my account every day on line just to make myself feel better since getting into this mess. I haven't had anything "go wrong". And hopefully it never will. But, as long as your not giving your new account out to anyone (especially pdl's or other "questionable" internet sites), I think you'll be just fine.

Cannr, youare really busy today with all you posts. They are so wonderful and i am learning so much. Thanks for putting my fears to rest. I guess if i think about it logically( a new one for me) that if such a data base existed EVERYONE would use it.

There are many databases banks and such use, but none of them have your account numbers in it. Your account number is supposed to be protected. The only thing that a pdl company looking at your report could find out is what bank you applied at.
