I'm very shaken here and don't know what to do. I have let an Ace Cash Express loan default and now they are threating me with a lawsuit and won't let me make any sort of payment plan with me. They said unless I pay them $1,200 by Friday they will contact my work, hr department and supervisor and file a suit for me writing them a bad check.
I will take any and all advice. I don't know what to do! Thanks, Jen |

Don't be shaken- I am in Illinois and I am trying to clear up 5 loans. You are going to get some great advice here. I know how you feel, but they want you to be shaken up, they want you to agree to some crazy terms that are crazy. Hang in there and you are going to get some great advice off of here.

Well, there is a plus side.
They cannot seek criminal charges against you, so if they are infact not bluffing...it's a civil suit simply asking for judgement. As far as I know, they are not allowed to speak to your employer reguarding your debt unless they are planning to take the amount owed from your wages. If they were planning to do that, it would make no sense to threaten you with a suit. |

Ok I just had the same thing happen to me today as well. The person I talked to wouldn't even let me speak hardly and they said almost the exact same thing as the above statement. Threats and how I'm being investigated for fraud etc... It got me really shaken up and the guy just started going off on my and pretty much hung up on me. Then when I called back he promptly told me that I was not to call back and they were going ahead with the case and instead of garnishment they had something better in mind for me.. and hung up. I'm freaking out here and would appreciate any and all help/advice. I'm located in KS.

this board will be able to help you, please do not panic. as kfstaff24 said, if it is legal, they can take CIVIL action against you, but i really do not think they will involved your employer unless it was a wage issue. either way, hold your head up high, we can first figure out if this company is even legal and even if they are, we can still help

well ACE is not legal in illinois people.and whoever is calling is bottomfeeder.the fact that they mentioned fraud was the red flag for me.there is no storefront pdl by this name in illinois.file AG and BBB complaints against this pdl.

I would file with the governing office in illinois first. Threatening criminal action is illegal in nearly every state.
If they continue to call you employer after you requested that they do not call, then you can file harassment charges per the fair debt collection practices act. Another inside tip. If you just pick up your phone and speak with them, even if you tell them you cannot pay. that is the only time they can contact you per 24 hour period. They cant call references, employers after they have spoken with you. If they persist, log a complaint. |

Well I'm back to let you guys know that I've taken care of the problem. I had to borrow the money from my parents to pay them off. I got that call and freaked out and there was no call to my job, I would know I answer the phones. I got a call from Mr. Thomas the next day asking if I had come to an agreement with my previous phone call. I explained that no I did not and how I was yelled at and threatned and hung up on repeatedly. He didn't really seem bothered by it and said, "Well all that matters is that today is a different day." Then he went into a speech of how I needed to pay if off but then he would allow me to RELOAN again. Ok so these companies are insane, they use scare tactics and force you to pay them off but ultimately just want you to reloan with them. I told him that I would be paying it off and never re-loaning again. He kept pushing me to go ahead and re-loan... We worked out an arrangement and I was set up to call him the following day.
I called him the next day explaining that I couldn't get the money together and could only make a small payment of $100 if he would take that. He promptly told me that the entire amount of $412.50 needed to be paid by 3:00pm or else they would go ahead and file whatever they had against me. In the end like I said I borrowed the money from my parents to pay them off. Needless to say, I would NEVER suggest that anyone borrow from Ace Cash Express |

Read thru this thread, and I will say that while most of the advice on this forum is good, some is not well-researched.
ACE Cash Express has storefront locations in Illinois. A simple search of whitepages.com or acecashexpress.com tells you this - if they've been licensed in Illinois for storefront operations, then they are not an illegal lender in the state of Illinois. I know the zip code for Elgin, IL, and the store locator on the company website gives me 4 locations within a 50 mile radius of there. |

Ace Cash Express is legal to lend in Arizona. They now offer Extended Payment Plans but you need to ask for one before you default. Approval is based on your history. If you have been in good standing alll interest stops and you make four equal payments. For example if you borrowed $500 add the $80 interest and divide by 4. Your payment would be $145 over 4 pay periods. I also reside in AZ if I can help further let me know.

Just tell callers "Don't call my work #" and call back the next day to be sure your work # is taken out plus any duplicates of the work #...be sure they look for duplicates under "icc" ect. Also if you can pay in full, then you can reapply if necessary. Also you can pay any amount while you account is in collections at ace, it just won't take your acct. out of collections status, they will still call, if it is out of the guidelines they expect. Pay something every payday. Even if it's 20. They don't report to credit agencies ..lucky for you but other collection actions will continue. Pay off ASAP and lower your living standards, don't refrigerate food or cook food, only eat foood for the day, unplug your refrigerator. live without it, it cost more than you think, It's cheaper to eat out than run a refrigerator. turn off your water heater entirely. Heat water on the stove in a big pot and place in shower, make comfortably warm with additional cold water and take shower with the limited water, scoop water with a bowl over your body. This is 3rd world method. Think smart, cheap, make changes, Make sacrifices. Pay them off

If the store front's not working w/ you in making payments, call corporate officeand tell them you defaulted, and want to pay back the amount but you don't have all the money but want to make payment arangements.
David.. just because you tell them not to call you, doesn't mean they'll listen. Chances are, they have more than one person working "Accounts". Only way to TRUELY get them to stop is to send them a CRR telling them not to contact you,references etc, and even then they may not abide by it, but at least then you have proof you told them not to contact you, and if they keep at it file a lawsuit. |
