Ok - I've been on the phone for the last two hours talking with live folks from the NY AG's office (3 different departments), NYS Banking Dept. and NY Bar Association.
PDL's are illegal in NY. HOWEVER if they are INTERNET PDL's and coming from a state where they are LEGAL and they are LICENSED PDL lenders in that state and you go under contract with them for a loan via the internet the loan CAN be considered legal.
Most of these companies do NOT hold licenses in the state they are from and they are not going to want to battle in a legal way because chances are you will prevail in a suit.
I filed my complaint with the Consumer Fraud agency of the AG's office. In all probability I was mishandled and now have the option to write directly to my agent's supervisor and state my concerns with how I was treated. I got his name by calling my regional AG office and going over the situation with them.
I am going to refile in the morning with the Internet division of the AG's office. In most cases they will mediate for you in an attempt to settle your case.
The NYS Banking department felt the AG's office was hesitant because they don't like to deal with things out of state??? They recommended the NYS Bar Assoc. Lawyer referral service but when I called the 800 number they provided I was told they do not have any lawyers listed for the area of Payday loans. I was told this is a "relative" new area and they don't have anyone listed yet.
I then talked to a rep in the Internet division of the AG's office and they suggest I refile with them. They commonly do mediate with these Internet companies. (The NYS Banking rep stated having letterhead from the AG will usually shut these guys down because they won't want to battle them because in all probability they will lose)This AG rep suggested I call a different NYS Bar number and the rep I talked to there said you don't need a payday or internet lawyer just ask for a referral to a lawyer that deals with consumer fraud. She says whether the case is legal or not in their home state when they come to deal with you in NY they are illegal here? Sounds like I went full circle.
My take is most of these companies are thieves and won't fight the fight because in the end they will lose since they aren't legal. I'm going to refile with the Internet AG and see if I can get some local lawyer to give me a 30 minute consult on my legal ground. I'm also going to try and find out which of my PDL's are licensed. I can't believe MTE is just because of how evasive they are. I'm now waiting to hear back from GECC on the certified letter they sent me yesterday. I found my copies of the communication back and forth with PD collections that they sent me to last month.
Bottom line is we need to keep fighting the fight. I'll keep you updated on anything new.

mperez, you go, girl! You are a fighter! And you're going to come out on top! I wanted to let you know, since I'm sooo into MTE Financial, that I checked with the states each pdl is in and they are NOT licensed. I checked MTE themselves in their state and they are NOT licensed. Just to save you the time and trouble of looking up anything MTE related, don't waste your time. I already checked and they are not. Not one of their pdl's and not them, themselves.

That's great Mperez...especially for poeple in NY. But I am glad to hear anything from the AG offices...my AG recently said they would mediate on my behalf all the complaints I sent and I was not sure what good that would do...now your post has given me some extra insight too...

Cannr, thank you so much for that MTE info. I mean, I already knew they weren't licensed anywhere, but for some reason, after reading Mperez's post, my heart dropped and I was starting to get scared thinking there was some kind of legal loophole they were going to jump through...since the only ones I'm battling are MTE, I am not going to panic...
Mperez, thanks for the info. We're in this together both being NYers..
The one thing I don't get is this, and I know I've said it several times...I also filed my complaint with the same bureau Mperez did...the Consumer Fraud division, however their response to me was so different..they said they would mediate on my behalf. Then they turn around and say they can't help Mperez? I can't understand this!

Thank you Cannr - out of the 10 loans I have left 6 are MTE related. So I'm going to ignore those for now. The 7th is Cash2day4u and I just filed with the FTC (thanks to another one of your posts) and I'm not going to worry about them. So that leaves 800-899-CASH and my 2 CPD's (my cash now and Discount Advances) to deal with - I'll post something later to see if anyone has any advice for those 3. I have to run fix my son some dinner but I'll be back. Thank you again for all of your support and encouragement.

You guys are so VERY welcome!  I know MTE! So it just saves you guys the trouble. And, also, forget Cash Today. Of course, they're not licensed anywhere either, so there's another one on your side as to not being licensed to do business with you! Happy Faces now!

Jen believe me I am equally as frustrated. I wrote the AG AGAIN and the Govenor on that subject. When I called the regional AG office he looked up your rep and mine then gave me the name of the head of the division's name and told me to write him a letter using his name and the address on the bottom of my letter. He told me to make sure I send copies of all the stuff I found on the website about what that division is supposed to represent and the response I got. Right now I need to focus on my own mess but I will think about what to do on the AG's office because I don't want anyone to have to go through what I have - If I wasn't so darn stubborn I would have gone away thinking I was the deadbeat he made me feel like I was - but I KNOW DIFFERENT!

hi you'all fellow ny'ers mperez and cannr, kudoos to you in your fight. i have asked you guys to pm me but no one has. i am happy for your success cannr with nyag they have not replied to not one of my complaints but i am fighting my battles with them (pdls)with the help of bbbny. just to update oneclickcash gave me a pif, usfastcash settled for 60 even though they said i owed them 238, ucloans has until aug 7 to respond, i erroneously sent the wrong first name and they replied to bbbny and said they could not find my ac, so i sent bbbny a correction and they have until august 5 to respond, marpast of texas has until aug 7 to respond, cash supply hasuntil today to respond, and last but not the least MTE yes MTE send bbbny a response that i was emailed that my account will be marked paid in full YES!!!! PIF!!!! to amicably resolve this matter i did not recieve the email so i contacted the bbbny again an d informed them that tendollarpaydayloan has my correct email address so i await their email for confirmation. i am not paying a dime more but girls i can tell you my fight is with the help of bbbny not ag office so mperez why dont u try to contact the bbbny to see if u can get any resolution.

Mperez, you are FAR from a deadbeat but you already knew that  !
What you experienced is simply gross incompetence at its best. I am convinced that once your complaints fall into the right hands, the correct actions will be taken. It's just a shame that you have to go through all this aggravation to get there.

Okay, I'm happy for everyone, I swear. But, what's up with getting a response from EVERY MTE pdl that you had and with great results?  Okay, they must like you! LOL! Apparently I am on their "hate list". Oh my gosh! Actually I am extremely glad some people are getting good responses from MTE - since they have soooo many d/b/a's, it takes care of a lot of pdl's for some. If they would deal with me, I've got 3 that could be gotten rid of, but nooooo, they like to torture me! LOL! Just kidding! Congratulations to everyone who gets a positive response from any MTE pdl! I think it's awesome!!!

There really seems to be no ryhme or reason to some of these pdl's. They will mark someone PIF with no fight, and others they will fight to the death on! It makes no sense, and I've stopped trying to figure them out.
