i sent ameriloan a certified letter not to debit my bank account anymore,but today they did so by a check can they do this

Tina, they are ruthless!
You have revoked the right to have them debit your account, yet they continue to do so. I have seen others on this board have success with going after them thru their ACH processor. You might want to give that a shot.
Otherwise, the only way to prevent them from taking $ from your account is to close it and open another one.

Get right on the phone call Intercept EFT at 1-800-378-3328, ask to speak with Cindy. Tell her that you have revoked authorization on your bank account but Ameriloan is still trying to access it. I realize that they put a papercheck through but that is not to say that they will not ask Intercept to try and debit on a revoked account at some other time. Cover your bases. Then you need to send an email to Ameriloan letting them know that you have spoken with Intercept. When I called, Ameriloan had not tried to debit my account for several months but I explained that the possibility of them debiting did exist and I wanted it to stop. You have to stop them at every turn and be one step ahead to do so. Good luck. Keep us posted.

They did the same thing to my account, I revoked the ach authorization and they put through a paper check that they had created a few days later. I disputed it with my bank & was able to get the funds reversed.

Tina,
I would dispute the check with your bank and get them to reverse it.
This is a classic example of why it is important to close a bank account, because even when you revoke authorization to debit an account, they will try whatever trick they can!
I'm wondering if when a person sends in a revocation letter that they be very specific stating "that they revoke any debits such as ACH, manual check or ANY OTHER MEANS OF WITHDRAWING MONEY FROM SAID ACCOUNT."

I think that pretty much all of my PDLs stated that if the ACH got squashed they had the right to produce a paper document. I don't know if they ever tried as I closed my account pronto.

Did you put the block on yesterday or did they actually try to debit your account yesterday? Can you email that C and D letter first, and then hardcopy it over? That way it will be there immediately. Got to be one step ahead all the time.

Can you close the account completely? That would stop them from putting anything through. If you can, and you do, make sure nothing will force it back open again. I would suggest that once that C and D is sent, you give Intercept a call and tell them that you have revoked with Ameriloan and your bank. Then pop off an email to Ameriloan letting them know that you have spoken with Intercept. They don't like being told that people are "telling" on them to the processor.

You have the right per the Electronic Funds Transfer Act to revoke reoccuring ach transactions. Checks are different. I don't think the ach processor would be able to help with paper checks.
If you look at your contract, it will usually say that you have the right to revoke ach transactions, and if you do, a paper check will be sent through, and that is not revocable.
This is why you need to close the account. Since you won't know the check number they will use, you can't stop payment on it.
