Was hoping someone could help me. I live in Arizona and have some internet payday loans that I am still owing from last year. I had gotten into such a mess with them to the point where my bank closed my checking account. The companies have been harassing me at work and when I ask for them to send give me an address where I can mail a payment they tell me that I would need to have debit card or checking account so they can debit the account for the payment.

Today, I received a call from the Eva Smart from Capital Group summons and processing regarding a claim received in her office. the voice message said that i was being notified that I was going to served with a summons for "writing bad checks." What are my options? What should I do?

In Arizona, payday lending is considered as legal. However, you will have to find out if payday lenders contacting you have the license to operate in your state. You can find this out by contacting the Arizona Department of Financial Institutions. If they are legal, then you can go for the option of debt consolidation with them in order to pay them off and get rid of the debts.

As of 7/1/10 payday loans became ILLEGAL in AZ. Go to " www.paydayloaninfo.org/state-information/10
scroll down to the bottom of the page and read the information from the attorney general. Also note from the AZ AG"

Yes. It is illegal to threaten you with criminal prosecution for writing a “bad check” in connection with the loan. Also, a payday lender cannot harass you to such an extent that it rises to the level of the crime of harassment (a misdemeanor).
Both federal and state law limit the tactics a debt collector can use, including restricting the time, hours, and places they can call you. For information on federal law visit the Federal Trade Commission’s website at: www.ftc.gov. Also, the Department of Financial Institutions regulates collection agencies in Arizona: http://azdfi.gov

If you borrowed from them before 7/1/10 you are obligated to repay the amount that you borrowed.
