I have a payday loan with Fast Loans for $500. Any way couldn't pay or roll over the dumb thing so after calling and telling them whats going on and that I'll be in at the end of the month to pay half or all of it, they freaked out now they are going to garnish my husbands wages(he isn't even on the loan) since i'm off work for an injury and I'm going to jail and the are going to take me to court for the amount plus what ever the law lets them sue me for..blah blah!!
So my question is if i'm paying them a little at a time can they do any of the above. I all ready called my bank after they ach the check over and over that now i'm $200 in the red...the bank said that they stop it and waived the fee to do it...very nice of them-lol Thxs for the help!!!

cow, I'm going to post your Arizona state pdl law for us all to see. Am I safe to assume that this is a storefront? Not an internet loan? If it is indeed a storefront, these laws will apply to your loan. Notice - please - that is says "criminal action PROHIBITED". So, they are threatening you with going to jail and garnishing your husband's wages? Please read your state pdl law and also verify if this is indeed a storefront loan.

Okay, the idiots need to stop running your check through. They shouldn't be able to any more (God, I hate it when they do it multiple times). Like I stated, criminal action is PROHIBITED. So they are passing idle threats to you (nice). They're full of hot air when it comes to that. However, since it is a storefront and they will be licensed/legal, you will have to keep in touch with them regarding the amount owed. You can't pay it in full. Sorry about their luck. The alternatives that they have could be to turn it over to their corporate office for collections (you can make payment arrangements), keep it in the store and let you make payments on it, turn it over to a collection agency (you can make payment arrangements), turn it over to an attorney for collections (you will have to pay the attorney fee, but you can make payment arrangements). If they want to be real jerks, they can take you to CIVIL court (not CRIMINAL court). What happens then? You show up, you tell them you can't pay it in full, you make payment arrangements. All the avenues point to the same result - payment arrangements. Some storefronts are just a$$holes and threaten you with illegal threats so they can get their money in full. If you can't do it, you can't do it. You can make payments. The key is to keep in contact with them (and it sucks) so that they don't call your place of employment, your husbands place of employment or your references that you put down. If they can talk to YOU, they will more than likely leave everyone else alone. You are not going to jail. You can not get into any "criminal" trouble. Okay? Just try to contact them and see what their next step is in getting this paid. Whether it be turning you over to collections or just holding the check at the store and you going in and making payments. Honestly, I found it easier to deal with the corporate office when turned over. They were nice, they didn't threaten, and we made payment arrangements. I didn't have to deal with the jerks at the storefront anymore. Give them a call, tell them you can NOT pay this in full. They'll try to con you into paying them (borrow from someone to pay them, etc). Don't fall for their bull crap. No one is coming to get you. You will not be thrown in jail. You just need to pay this off. If it means making payment arrangements with their corporate office or a third party collection agency, then so be it. Honey, I've been there! Ok. I know someone that keeps getting small loans of like $100-$200....and this week she will be getting a $500 loan...she gets the loan, gives them her bank information, then a couple days later, closes her checking acct.
Then a couple weeks later she does the same thing again. Shes even went as far as changing banks so she doesnt have to pay back the loan! Isnt that considered fraud or theft?
And would it be considered a collection case or criminal case? We live in phoenix, arizona
Please help... thank you

That could be considered a criminal case, if they could prove that was her intent all along to close her account without paying.

Could they really come after you as a crminal for closing your account on a payday loan in az? I looked up other state laws, and some said prohibited (unless account is closed or check is returned for NSF) Arizona`s law says only PROHIBITED.

I've talked to the department of finacial institutions in AZ and no, you can NOT go to jail for defaulting on a pdl.
To the original poster, if this is a store front loan, Report them NOW.
That is an empty threat to collect a debt. They cannot legally garnish your hubbys wages and you will not go to jail for it.
Store front's should know better....give the department a call and give details, ask how to file a complaint.
Now, the person who is opening accounts and closing them after getting a pdl, yes. That person can go to jail if they are caught. They fraudently took out a loan knowing they would not pay it back and purposely closed the account for the sole purpose of defrauding the loan company.
Not to mention the said person WILL not be able to get a bank account soon. It's all on records with bank as to her history and that person will be black listed.

I had a payday loan in Mesa. I could no longer pay the interest fee's. The loan office tried to deposit my check several times making my account overdrawn. I tried to keep in contact with them and also tried to make payment aragements with them. They would not take the payment aragement, they wanted the full balance. Three weeks later I received court papers and the garnished my wages. They took over $ 150.00 per week out of my check. I did take them back to court to get the amount reduced and the judge did award me that, however the loan was almost paid in full so it never went into effect.

Unfortunately store front loans are legal in Arizona and yes they can take you to court. However, it is a civil matter not criminal and thats where people get confused. I am sorry that happened to you but thank you for sharing your story so others are aware.
The person above who keeps taking loans and closing accounts should go to jail, that is criminal behavior. This forum does not condone that type of activity.

i have 7 pdl, now i am not able to pay the extensions anylonger, can i just do stop payment at mybank and wait till they callme and set up payment arangements

The state law says only 1 loan is legal...what if you have several ? Does this mean you've broken the law in a way that could allow pdl's to file criminal charges...(because you've violated the state's limit law) ?

Currently the payday loan stores in AZ are unable to confirm if someone has more than one loan, they are not linked by computer. Having more than one loan is not criminal, and some stores never even ask because they really dont care. Its all about money for them.

i currently have 10 PDLs. i can no longer afford to pay the interests. i was making no progress in paying them off. I signed up with PDL consolidation but the stores tell me they dont work with them so now im stuck. i already closed out the checking account. the calls are starting to come in and im hating life. any advice
