Can someone tell me if it is true that if you close your account in an Arkansas bank to avoid ACH withdrawals, it is a crime? I have done a search, but cannot find it. My bank is in Arkansas.

I would think it depends on why you are avoiding the ach withdrawals. If it is to stop illegal withdrawals I would speak to the bank first and enlist their help.

Are you in Arkansas? Is the reason you want the ACH debits blocked because of unauthorized debits by illegal companies? This makes a difference. If you want to block debits from pdl's, we can post your state law and see what it says. However, if it's for another reason, please post and we can see if we can help. Very Happy

I live in Oklahoma, but I bank in Arkansas. I think I read somewhere on here that if you close your account to avoid ACHs it is a crime. Yes, I would be closing it to avoid the ACHs of the pdls. I have already sent them letters that I revoke my ACH withdrawals. Thanks!

I've actually talked to the AR DFI about this. What they told me to do to acoid any sort of trouble is this:

When you go to close or freeze your bank account, print out and take with you some of the threads from this site about pdl's taking out money when they aren't supposed to. Explain to the bank that you are closing your account to avoid potential fraud.

They told me that odds of prosecution are very small, but to do that just to be on the safe side.

But if you live in Oklahoma, the AR law wouldn't apply to you. You would be under OK laws, so you don't have to worry about that. In OK criminal prosecution is prohibited.

Like I've said in another thread, always be upfront and truthful with the branch manager of your bank. If you cannot get to a branch, since you're in another state, and you have to use their 800# to close your account, put the request in writing and mail it to a branch, attention to the manager. Include those print outs of threads in the forum to support your request. Always be honest, it gets you further with the bank.

I totally agree . . . . If you are honest about your situation, take responsibility, and show you are trying to fix it, people are more likely to help you then if your story sounds kinda fishy.

Swedishgirl can attest to this - Bank employees have heard it all before. You aren't going to shock them easily.
