Ok here we go again...I just recieved a letter from the attorney Vincent P Cignarale LLC of NY. In this wonderful letter he informs me that our 'debt' to $10 dollar payday was bought by First American Investment CO. and that we owe them 765.00
Now i know that $10 was an illegal company, but I know nothing about this First American or for that matter about Cignarale.
If First American is a legal company, can they try to collect for something that was made by an illegal company???
I am so sick of these idiots harassing me I just want to fly to NY and slap em in the face with a cease desist and a leave me the heck alone order!!!
Anyway any information, advice or help is greatly appreciated
And Cannr...you played a huge huge factor in me having the guts to blast away at them in the first place

Ok I have to try and get some sleep to kill this headache. Hopefully I can get on tomorrow and do some more research and get some advice. I did learn that his office was just 'formed' legally in newyork as of 10/19/07 and he just passed NY bar exams in 11/06.
Also the bottom of his letter states ....and i quote..." This communication is from a debt collector"
so i am even more confusedededed than when i started.

I don't know about this particuliar company, but all collectors have to put the mini-miranda oncorrespondence. There are attorneys that are also collectors.
I am working with one-or rather am trying to!!
Anyone can TRY to collect-doesn't mean they can or will!! I will look to see what info I can find on them for you..Take a breath-we are here to help!..karen

Ok slow deep breaths yep still breathing ...thank you Karen. Did you happen to see the post where i found some information on that first american? I found it to be very interesting information and i am trying to dig a bit deeper.

i2, keep digging and finding information. However, regardless, this is an illegal debt. collection agencies can "purchase" debts, the pdl can turn the debt over to collections, etc. Point being, this is an illegal debt regardless. I have had two of mine turned over to collection agencies, i2. I ripped off some nasty emails and then demanded debt validation from them (let them validate an illegal debt). One I got taken care of via email (still filed complaints on them for trying to collect on an illegal debt). And the other, I have sent TWO letters demanding debt validation and have yet to hear a peep out of them (yes, filed complaints against them also). So, i2, they can ATTEMPT to collect this debt. However, always keep in mind - ILLEGAL DEBT. So, fire off a debt validation letter to these morons. You can do what I did and tell them in the letter "I'm sorry you're attempting to collect on an illegal debt...." I thought I'd throw that in so that they are aware that we're not all stupid and know it's not a legal debt. Send out the debt validation letter. If you need a good one, let me know. I can pm one to you. If it so happens to hit your credit report, dispute, dispute, dispute. Dispute it with the credit bureaus (they will do an investigation on it) and dispute it with the actual collection agency. Dispute the hell out of it. Out of the two that got turned over on me, one did hit my credit report. I was on that faster than you could blink an eye. However, it probably hasn't gone that far yet (however, I would check just to be safe). Send the idiots a debt validation letter. Post or pm me if you need a letter to send, okay? We can do this. It has been done!

Thank you so much cannr...I have been digging and crying and growling and yelling then laughing just to keep my sanity.
I just found it interesting how when confronted with the information suddenly it was sold. So now the 'attorney' is working for a bad corp, who bought a debt from an illegal company cause they couldnt collect. Vicious circle isnt it? Just gearing up the energy to blast em again

kiwi, "illegal debt" - one that might be a pdl that is not licensed/legal to lend. Is that what you were asking?
