Whats the next step

I stopped all ACHs from my account for my PDLs but now I need to know what to do next. The calls started today. Do I answer these calls, do I send them letters? What do I do. I don't want to get as far as getting the "we are going to send you to jail" calls. Should I try to work something out with these companies?

Hello -

First, let me put your mind at ease about the "you are going to jail" calls. If you get them, blow that threat off - you are NOT going to jail. You cannot be arrested for defaulting on a payday loan.

Second, did you close your account, or just block all ACH debits? Be careful on this, because some payday lenders have been known to convert your debit to a "paper check" with a fake number (like 9999) in order to continue hitting your account when you block ACH debits. Sometimes the only option is to close your account and open another. Most banks are understanding about this when the situation is explained to them.

Third, you need to know whether you've overpaid these companies already, and if they are lending legally in your state. If you can let us know what state you're from, what companies you're dealing with, how much was borrowed, and how much you've paid on each one so far, we can give you more solid advice that will help you take the next step.

I just blocked ACHs. I didn't think about the possibilty of them converting to paper checks. If I close my account won't I have a hard time finding another bank after we get onto the BAD account list? I live in DE which has no limit on interest rate or fees only amt you can borrow and the # of rollovers. Here is a list of accounts, amt owed, and amt pd.

United Cash Loans x2 $200 (paid down from $350) pd $785 on each

I really need advice as what to do, addresses, how to handle these calls, what to offer, how to handle this now that I stopped ACHS.

Nowwhat - If "bad account list" is referring to chexsystems, then you can still open another bank account. In your state, try FNSB, HSBC, BofA, or Citizens bank. If you try BofA, apply online, don't go into the branch.

Thanks for that info but what about the other stuff? I have already gotten 5 calls today. I know that most of these sites are NOT licensed within Delaware and that they have to have a Delaware license. Do I send out letters to this affect and tell them to kiss off or ask for a payment plan? I don't have time to field seven hundred phone calls a day. I don't know how to approach these companies.

If these companies aren't licensed to lend in your state then they are breaking the law. File complaints against them!

Also, it's pretty hard to get them to stop calling. You can send them a letter certified mail requesting that they don't contact you at work, but most will just ignore that.

I would send out letters mentioning their licensing status . . . . . . On the ones that you've way overpaid I'd request that they mark you PIF. The ones that you haven't paid back principle on set out a payment plan.

I also live in a state that didn't have any interest rate caps, but since the companies weren't licensed I was able to get quite a few marked PIF. You just have to keep at them.

I would just hang up on them when they call, or say you don't work there anymore. They will probably still call, but you could try to have some fun with them. Mess with them. Talk to them in funny voices, speak jibberish, stuff like that. That may encourage them to stop calling you too.

Anyone have the email adresses/physical addresses for any of the companies listed above. I have started writing letters to them and need to get them out certified mail today. I also really need to email one click cash asap. They called here all hours of the night and even called my sister at 11 last night. Please help.

Okay, take a breather. It sounds like you have some of these overpaid and you can send them letters to this effect. I have been in this myself and I had a lot more lenders. You will want to work out a payment plant with Cash Net USA first. I believe they will probably be licensed in your state. I have not dealt with them myself but this is what I have gathered from other posts. You can do a search around the forums for some of the addresses or go to the BBB website. You will probably hear from a company called Credit Protection Depot regarding my cash now. They collect for them and they are located in Nevada. You will want to send them e-mails stating not to contact you at work, home, or your references regarding this matter. I would keep e-mailing them until they listen. You can also fax them and I also suggest letters via certified mail with return receipt. Also, for the ones who are truly harassing file complaints against them with the BBB, your state's attorney general's office, as well as your division/department of financial institutions.

I just received this from my cash now's collection agency. What do I do now?
