Hello i live in California and I am in a very bad bind i have the following storefront loans and they are killing me . my paycheck goes to them in finance fees. i have a brand new baby and a 9 year old and i cant afford to take care of them or pay my regular bills because i cant get out of this trap. please help

store front

check in go $300
check into cash $300
atlantic fianancial $300
advance america $300
speedy cash $300

online

cashnetusa $300 - in default as of march
cash central $300 - in default as of march

I am in dire need of some help in getting out of this mess. please some one help.

Hi Jess - Here is the payday law for California:

First and foremost, talk to those storefront lenders, and explain that according to state law, you are only supposed to be allowed one outstanding loan at a time, and at this time, you are far in excess of that. Discuss repayment plans with them. Be careful not to make any legal threats or offers of repayment that you cannot keep. If you make a payment plan and default on it, you will be in worse shape than you are now. The storefront lenders are the ones you must be the most careful with.

You stated you are in default with the internet lenders since March - have they contacted you at all?

You will have to call the storefronts, or go there and explain your situation with them. They may work with you. There are a few debt consolidation companies that will work with them also. Hopefully someone here will come along with a name of one. Keep watching your thread. How much have you paid the internet PDLs so far?

in answer to the question above regarding being in default with the online ones since march yes they have contacted me and they are threating collections but i cant afford to pay them. i have had them for some time before i defaulted with them so i really dont know how much i have paid them so far

Jess,

I believe Cashcentral and CashnetUsa are licensed in MOST states, but not all.

Check this link out to find out whether they are really licensed or not. Your original contract with them will have the dba name. I defaulted with them, and they are accepting my money orders and the collection calls stop. I've only been able to send them about $20 for right now because I'm catching up on my other bills and they will cash them. Send them the money orders via certified mail, and you can always offer to do small increments by prepaid debit card too, so you don't have to give them any new bank information.

They will tell you that they can't accept smaller amounts, but just be stubborn and send what you can afford because no matter what they say, they still will take the money, even if it's $10! I've been in default with one since January and another since March, and they haven't sent me to any outside collections agency (I believe Cashcentral does its own in-house collections anyway).

You will have to make arrangements with the storefronts since they are licensed and can take legal action

Jess, if the storefronts pursue legal action against you, you will have to face them in court and explain why you haven't paid in front of a judge or mediator.

If you choose not to show up for the court date, the judge will enter a judgement in their favor against you.

Well I havent defaulted on any of the store fronts. how would i go about asking them to help me out payment arrangmetns wise any thoughts

My husband did show up for his court date, and I went with him, but it still didn't make a difference. The judge ruled in favor of the storefront, Check First Cash Advance. He didn't even look at our paperwork from T & C or let my husband say more than two words. It really depends on the judge and where you live.

Oh no i dont want to go up against a judge i mean i have no problem paying them off its just that their fees are waht is killing me and the fact that i dont make alot ot pay all of them off up front so i have to keep borrowing them. So how do I go about asking them for payment arrangment any thought????

jess - simply go to the storefront lenders, one by one and ask them for payment arrangements. Explain that you are over your head in payday loans and want to get out of the cycle so you can pay all of them off. They should be willing to work with you.
