My husband and I are about to file bankruptcy and have 2 payday loans off the internet. Should we not pay them? Can they come after us?

Personally, I would not pay them. You will however need to do an ACH revocation and close your bank account and open a new one.

Okay one of the loans is from Ameriloan which on the site says they are tribal. The other loan is from Pay Day One and they are licenced in the state of wisconsin, where we live. Kinda worried about that one but our financial situation is horrible right now. We cant got ahead, which is why we chose to file bankruptcy. If we stop paing the Pay Day One, because they are licenced, can they legally come after us even if we are filing bankruptcy?

Where would I get an ACH revocation letter? I hate that we git ourselves into this situation. And I appreciate the help you have given us.

There are sample letters in the link in my signature line as well as step-by-step instructions for dealing with illegal lenders.

You need to include PayDayOne in the bankruptcy.

Have you paid anything to Ameriloan?

Sub: #6 We have paid on both if them. Also found out my husband took outMon, 05/21/2012 - 10:02

We have paid on both if them. Also found out my husband took out another loan last week because my dad was hounding us for the money we borrowed from him. So now I'm worried that will mess up our plans to file this coming month. I don't want the judge to think we are committing fraud, we really did just decide to file this past weekend. He took the loan out through usfastcash.com for 400. I understand why he did it, just wish he talked to me first. so now I don't know what to do. Still planning on closing the account and revoke ACH. Uuugggghhhh

USFastCash is not licensed to lend in any state in the U.S. Just don't include it in your bankruptcy, repay the principal only.
