I don't know if this info will help you, but Cashland is a member of The Community Financial Service Association of America (CFSA for short) and they must abide by their rules. The website is cfsa.net if you want to know about it. Also you said that they refused your minimal payments, I know for a fact that they have to give you an Extended Payment Plan (EPP) for short that allows you to pay back your loan in four equal payments that are due on each of your next 4 pay periods. Of course if you were trying to do less than that then this info wouldn't have helped you at all. Also, since Cashland is legal and licensed they will come after you for their money if you don't pay them. I would try to talk to them again to see if you could work out something outside of court. The moderator is the moderator because he definitely gives sound advice. I was seriously in debt (and a year at law school did not greatly help but did not hurt) and was starting to be sued. Do exactly as the moderator said-Answer that complaint. It is not hard. You can use exactly the same format as the complaint, since they will obviously research and do what is required by your court of jurisdiction.

File for discovery-demand the paperwork (often lost and they will in turn file to get a summary judgement and you need to stick to your guns).

However, without legal advice and it may be prohibitive, it is hard to win if you are in the wrong. However, I defaulted on a Cashland (and I was in the cycle and paid many many early or on time) loan and they made arrangements with me. I made the ifrst payment as agreed-then told them I was paying at a certain rate until paid. They said it was too long and I said it would be paid off long before they could get a judgement then the garnishment shich in turn tkaes time.
