I received notification by local municipal court that CashLand is suing me for balance due. I defaulted and have paid half of what's owed ($380 pd), but ran into difficulty repaying when my husband was laid off. I'm not sure what to do. I really do not want this to go forward. Any suggestions; advice?

Ohio... storefront. I tried to set up minimal amounts, but was refused. They wanted the other half in full and I couldn't make that payment

Wow, sorry to hear this, when I defaulted with CashLand last year they sent me to a collection agency. If they have the courts involved then there is a chance you can not do nothing. One other idea I can think of is go to your court house and make a payment in an escrow account. I believe you can ask for a continuance and that may buy you some time. Maybe you can put half in a escrow and have the other half when the court date comes up. I'm just thinking out loud and do not know for sure, but it maybe something you can ask the court house.

first and foremost make sure you file an answer with the court so that you dont end up with a default judgement. second contact them and see what you can do to negotiate payment. then do as the previous poster suggested and sock as much money as you can between now and the court date (if you go that far) that way at the very least you can come to court and state that on that day you can pay x amount and the balance by y date. depending on the court, you may have an option for mediation.... if so, use it adn try and avoid the judgement

I've also seen other posters say that if you take your budget to court with you, showing your income and expenses, and if you show that you have tried to make payment arrangements that they have refused, then the judge may tell them to just work it out with you.

I'm curious to know when you defaulted on your Cashland pdl and how long you paid on it before they served you with court papers?
I too am in Ohio and at the end of this month I am going to have no other choice but to default. Things have gotten so far out of hand myself. I don't know where to start.
I called the Ohio coalition of responsible lending and they pretty much said that the pdl companies can do whatever they want. I think the new law that has been signed should have had a little more revision to it as far as collection procedures etc.

Does anyone have a copy of a Cashland Truth-In Lending Statement? There was one provided in the summons, but it doesn't look like anything I have ever signed and all I remember receiving is a ticket receipt every time I took out a loan. I just want to compare information.

Sorry I have no copy of that, but I have a question. How long since you defaulted? Were you on a payment plan when you defaulted?

I may be having trouble with Cashland in the future too. They won't accept the payments T & C are making them and they left me a message today saying they were going after my wages. T & C said if it's an assessment, my employer can refuse it. If it's from the court, they would honor it. I faxed and mailed a cease and desist letter to them and another one this morning. Can they still take me to court even though I'm working with a debt consolidation company?

I think they can, as they don't have to work with DMP, I'm wondering if these places aren't getting even more ugly because of the new OHIO law, maybe since the stores are about to close they need to secure payments...

Even if they do take you to court, you would be able to show the judge that you are trying to pay your debts and that they are refusing to work with your DMP. It seems to me that the judge wouldn't necessarily rule in their favor.
