|
|
|
Does a cease & desist letter work for payday loan companies, such as Cash Transfer Centers? I have sent them a letter to revoke the wage assessment that I signed and have contacted my payroll company and finally I have filed a complaint with the Ohio Attorney General. All the examples I have read of cease & desist letters are for a collection agency. Any help with is appreciated.

CTC is operating from Malta and will not care. They will however try to settle with you if the wage assignment fails. Iwent through it with them. They have a call center in British Columbia also.

Yes, from what I have read on this site they are one of the worst ones to deal with. Honestly I tried to work something out with them but they demanded the whole amount repaid immediatly and I wasn't able to do that.

When I dealt with CTC, I faxed, mailed and emailed the letter. They stopped calling after about two days.

I haven't heard from them either since I closed my account a couple of weeks ago.......I told them in their email that it was an illegal debt but willing to pay back the principle only even though I have paid well over in just fees alone...I think we emailed back and forth twice and that's it...not sure what to expect from them now....hopefully they are gone bye bye and i won't have to worry...keeping my fingers crossed......for all of us..

They are illegal. They are overseas. They are horrible. They will send a wage assignment to your employer to try to get money from them. A wage assignment is totally voluntary, so it does not have to be honored (plus this is an illegal company anyway). ginurse, you're going to have to at LEAST send them a letter revoking wage assignment. This way your butt will be covered if they send one to your employer. Also, you're going to have to close your account to prevent them from debiting. What state do you reside in?

ginurse, they won't. They are very illegal and don't give a crap. Honestly, the only thing you can do is close your bank account to prevent them from debiting you. You will need to send them a letter revoking debit authorization and wage assignment. Especially the wage assignment because they WILL send one to your employer. I'm going to post your state pdl law just so you can see it. However, CTC is illegal - period. I am also going to post something regarding closing your bank account. If you have any questions, please post. We can help you.

| Quote: | Before you close your bank account due to payday loans eating away at your paycheck, please read this.
Some banks have a policy regarding ach transactions that allows them to force open closed accounts if any ach transactions go through within a certain time frame after the account is closed. This can leave you owing a legal bank $1,000's and reported to chexsystems, instead of owing barely legal (or not at all legal) payday loan companies. Not a good thing. Ask your bank what their policy is on ach transactions on closed accounts before you close the account. It's best to go in person and talk to a branch manager.
If your bank does have this policy, tell them your situation. Don't be embarrassed. Take letters with you showing that you have revoked authorization for each of your payday loan companies to debit your account. Tell the bank to put your account on deposit only, an ach block, or a hard hold before they close the account. Your bank can do one of those, don't take no for an answer. This will prevent any payday loan ach's from reopening the bank account.
It'a always best to close your bank account. Leaving it open gives ways for the payday loan companies to continue to take money out. These companies have many different dba's, so blocking them won't work. They will also produce paper checks and run them through your account. Closing the account is the best way to prevent these companies from taking money out of your account.
Some state laws do allow for prosecution if you close your bank account, but that is usually in cases of fraud. But it's always best to check with your state's attorney general or department of financial institution before you close your account. You want to make sure you are not causing more heacaches!
