Hi everyone..I hope someone can help me with this.
I have three payday loans.
1.Advance America -original amount $800, payback $963. I paid $360 in September and haven't paid anything since then.
2. Ace Cash Express.Original Loan $610, payback $730. I have paid $224. They keep calling me at work and saying that they will press charges for theft by check and gave me a deadline to pay $300 yesterday. I couldn't and I am freaking out now.
3. Check n go. Original loan $800, payback $930 (I can't remember exactly). I have paid $50 on this one and am working on a payment arrangement with them.
My bank closed my account on october 19th. This was after all three companies tried to cash the checks I had given them at the time of taking out each loan. The bank closed the account because it was overdrawn for too long. I didn't realize they had closed the account until a day after it actually happened. As far as I know, none of the companies tried to cash the checks again since then. Can I get in trouble for theft by check? I am seriously trying to pay them off as much as possible but they (Ace specifically) is being adamant that if I don't pay off the remaining 600 by Nov. 17th they will press charges. What can I do????? Please help.

All the places you are dealing with are operating as CSO's in Texas. A CSO means Credit Service Organization. This means that the laws posted above do not apply to them, unfortunatly.

Unfortunately you are going to have to make arrangments with them. You might consider a debt consolidation plan. There are some companies that will work with payday lenders. Do not let them bully you, you will not be arrested if you are keeping in touch with them. Do not ignore them however because Texas has some check fraud laws that apply to stop payments and closed accounts.

Thanks for the responses.
Well I have been keeping up with them. I have not been able to make the full 300 as demanded by Ace, but I have been making smaller payments (100 in september and then two other payments totalling 124 in October and november.) I will finish paying them off on the 17th but the lady who called yesterday said that if I don't pay the full 300 by yesterday then I should seek legal action. I am so scared. I don't know what to do...I couldn't even sleep last night:( Do you think it will be ok if I just pay them off next week when I get paid? I have all intention of doing so but I am trying to pay off the other two at the same time. This is such a big stress on me.

cathy, did you try calling the one that demanded $300 yesterday and tell them that you will pay it in full next week when you get paid? The key with them is communication. If you try calling them and stating "Sorry, I didn't have the $300 yesterday, but I will have it next week to pay you in full", they may just hold your check until your payday. Give that a shot. You're offering to pay it in full. That's what they want. With luck, they'll hold it for you for another week to get their money back.

Yes I spoke with her again yesterday and she said that I could pay it off next week on the 17th. Thats a bit of a relief. I lost sleep over this so much and was stressed out to the point where I couldn't even do my job. I'm not sure how I will cover my bills for the month though, especially my car payments and light bill which I have been running behind on....it just seems like i will never get on top of my bills again! Thanks for the advice.

cathy, I'm just relieved to hear that the storefront is going to work with you! I was concerned! It sucks your bills are going to get behind though. If you need any help, just let us know. Don't let yourself get stuck with your power being turned off or anything like that. Your living expenses should come first. I know it's hard trying to pay your regular stuff and now all this on top of it. We're here for you.

I am so worried though cause now my bank is sending off non-sufficient notices for my other bills. (I have another account) I am so scared I'll get in trouble not only with these pdls but also with my regular electricity/car company etc cause they have also tried to send through payments that were set up automatically. I've already called them all and explained (not in much detail..its so embarassing) that i will take care of the payments that bounced hopefully over the weekend. I don't get paid again till the 17th and that is when 1/2 my check will go to Ace and then the rest on trying to cover some bills that didn't go thru. I don't think I will ever catch up with my bills for a really long time...not to mention how bad my credit is now..this whole pdl thing was such a BIG mistake:( Anyway, thanks for the support.

Hi
I have a question.Does anyone know how the 90 day repayment plan works with Checkngo? I read about it in newsweek.com. I unfortunately got trapped in this mess since March!! I don't have the money to pay them this Friday!! I thought about just taking out all the money from my account on Wed. when I get paid early and putting it in my husband's account instead at another bank to pay off some bills and just pay them next week or the following? What do you recommend that I do? I got the loan online.

Are you talking about the Extended Payment Plan? If they are offering you a 90 payment plan, and you can afford to do it, then go for it! Be done with Check n Go!

I have a question and I am hoping that someone can help me. I have 4 payday loans out and they arent that big I think about 1200 all together .. I have been paying 940 a month fpr the last 4 months and now my bank account is overdrawn I have no money to pay my bills or take care of my kids... I was wondering if it would be better for me to close my account and then take one a paycheck and pay them off. Would I get in troyble for that ?? hey have not called me or my employer but I dont want it to get to that point either. I have already had to move to a cheaper place because I was behind on rent and now I am late on my car payment as well. I live in MN HELP !!!!!!!!!!!

nikkij, are these 4 plds internet or store front? I am going to post your state pdl law so everyone can see. However, we will need to know whether they are store front or internet. Also, if you could, please list the names, the amount borrowed (principle amount only), and how much you have paid so far. With this information, we can help you further!
