a pay day loan company levied my check for 75% for loan repayment. then the next week took another 60% that a judge allowed them to take. I beleive they were sending certified letters. I never picked them up from the PO. Then the judge levied my payroll check. I am the only one working and this really hurt my family. can another pay day loan company do it again. I would think they can?!?! So how can I stop them?

Your paycheck is being garnished? What state are you in? There are caps on garnishments.
Who is the payday lender you are referring to?

Is this a store front we are talking about? An illegal PDL could not get a levy?

Until we get a response from nikki, I'm going to assume this is most likely a storefront pdl. I just can't see a judge allowing this for an illegal internet loan.

Just off the top of my head, there are indeed garnishment limits and I dont know of any state that would allow 75%!! AND then another 60%???

Yea but even a storefront..even any judgement for that matter can only garnish so much!!
I wonder whats up with this situation.
Most states are around 25%...

I currently have 7 payday loans out through the internet. They are killing me with these fees. How can I get rid of them without getting my paycheck garnished?

Federal Law caps the amount that can be garnished at 25%. No judge would allow more.
I think this is an internet loan, and a wage assignment.

This is definitely a wage assignemnt. Garnishments are federally mandated at 25% for consumer debts, period, regardless of your state. Federal debts are a whole different animal. To be honest, with this kind of assignment, I'm surprised you have gotten a check at all. There is no cap on a wage assignment.
There is no way you can get this money back, but you need to provide your employer with a letter of defense..which says you do not authorize any wage assignments..NOW!! You need to give this to payroll before sending copies to your pdls.

Thanks goudah and fins. That was a LARGE amount of money. Actually, the member from before who's employer honored her wage assignment (could still kill them) was taking almost her entire paycheck. Amazing.
