Okay, I defaulted on this loan at the start of March and of course they harassed me non-stop about paying them a lump sum. I got up to 20 calls a day, and always told them the same thing, that I am willing to pay them back but I needed to make payments which they refused to do. Finally, I wrote them a letter asking them to cease calling me at home or work and to please communicate to me in writing, but they didn't listen. At this point, I filed a complaint with the ohio Attorney Generals office about their harassment, and I filed one with the Ohio Department of Commerce, and in addition I offered to testify before the Ohio Senate on how payday loans had destroyed me financially since they are working on a bill to cap the PDL loans at 36%. I forwarded all of these letters to Checksmart and all of a sudden the calls completely stopped. I have not heard anything from them for 2 weeks now, but I was wondering if anyone knew what their next step would be?

I know from being on this forum for a long time that Checksmart in Ohio is usually pretty quick to take you to court. Ohio has it's own special court for this stuff, it's almost like bad check court, but not quite. You sit in a room with reps from Checksmart and a mediator and come to arrangements to pay off the loan.
But I've seen many many posts where they have taken this step with people that have defaulted in Ohio.

Goudah is right, they are hard to work with and they will take you to a "court" type hearing to "work it out" Hopefully our buddy Ryan will stop by and give you more tips, he has dealt with them in this type of situation. I'm from OHIO too and I'm so glad to see the meetings being held about these PDLS, I pray something will be done! Good Luck, Reny

Everything Goudah said happened to me. They would not accept payment arrangements, they wanted me to come back to the store to re loan. I told them I wasn't and over time (maybe a month or two) they took me to Check Mediation at the Franklin County Courts. Mediation is you set with someone from Checksmart and a clerk from the Court House. You come up with a payment plan. They will try to get you to pay them off in 4 payments but I was able to talk them into 6 months. I looked at the calendar and realized it’s been a year now since I defaulted with them. Hopefully they still do everything that I experienced back then.
