i have spoke to many attorneys and judges. they have all said the only debt you can go to jail for not paying is child support. so payday loans can go to HELL. sorry for the language but it makes me mad when these PDL idiots say you are going to jail. JUST REMEMBER CHILD SUPPORT IS THE ONLY DEBT THAT IF YOU DONT PAY YOU GO TO JAIL.

thank you, well i have made my decision, and i am going to stick with it, so if it takes me a year so be it . i did not get into this mess over night so i wont be getting out of it overnight either.

Thanks for the info wtl1980- I just wish that they would crack down on the dead beat parents on not paying child support. My X husband owes me thousands for child support.... Twisted Evil

I think they are a few others (probation fines, etc.) but you really can't go to the jail for payday loans. i wish someone threatened that on me! I'd laugh and hang up! I can see Geneva Roth trying that next Wink

Please do not forget Taxes.......If you do not pay Uncle Sam and Uncle Governor there is a strong possiblity that you could go to jail.

Under certain conditions, a debtor could land themselves in a criminal matter over a debt if they have engaged in a deceptive act in order to obtain a loan. For example if you make false statements on the initial credit application (lie about your job/income/address/etc), then that action can be regarded as theft by deception.

For the most part, that is rare. As long as you were honest in all your dealings, then you cannot go to jail over a civil debt.

sorry but I am owed over $25,000 in back child support, neither I nor my son will ever see it much less will they send that deadbeat to jail, or even suspend his license. It is VERY difficult and expensive to get the court to act on it.

Some states are good about child support collection, some states don't get very involved.

In IL they list deadbeat dads on the state website. The state will also suspend their drivers license and issue a warrant for their arrest when they don't pay.

BOTH parents need to take responsibility for their children. I think it's SOOO pathetic to read or hear how ( mostly) fathers could care less. Or.......the other way around. I've known single mothers who say "if you don't pay child support, you don't see your kids." That's not right, either. The only person you hurt, in THAT case, is the kids.

There are deadbeat mothers that don't pay their child support, too. My husband's ex wife was one of them for years, and she never saw any jail time, not even a slap on the wrist.

I agree, I also know some women who use the child support money to go out with friends. Kids should come first, regardless of gender, etc.
I know in NJ, they send someone to jail in a second for missed child support payments.. I guess it depends on states?

I've seen kids takening from their mothers......for good reason, I may add. I do OF someone who lost their kids and was ordered to pay child support. from what I heard she stopped working just so she wouldn't have to pay. That's so much crap!! All this person wantes to do is party ( I know THAT much about her, anyway..) and not take responsibility. Her mother ( the grandmother) has custody of the kids now.

hopefully she'll clean up her act and realize what she is doing (and I mean TRULY be sorry!) before the kids are too old to realize what their mother is doing (if they are not older already).

That's true; but I don't think any of us will get telephone calls from the Feds or State people saying that they're going to "download us," or "see us in the British Court of Law!!" (smile)
