Hello forum, I have a $900 loan with CashnetUSA since Oct. 06. My loan is going to default on Friday since I am unable to pay the fees any longer.
My question is: PDL are legal in FL with a max of
500 $. I guess this would be for store front paypay loans. If IPDL are illegal, how do I go back and request a PIF or even complain to SG office? I just need a light on how I am going to approach this PDL. I have paid in fees alone, 3569.22. Anyone who has loan with this company, they make you pay if off the loan on every 5 payment. How do I work on this one?

We need to look at the FL law...they loaned you over the max number 1. Number two if this a ipdls..it looks to me that you have way over paid them by now...hopefully somone who has worked with FL laws and/or this pdl will come along and give specifics.
Were they debiting your account in the bank?? Have you closed the account??

By the way, where in the blogs can I look at a sample letter requesting PIF?

queen, check to see if CashNet is licensed in Florida. I keep reading on here that they are. Frogpatch is in Florida and very good with Florida law. Also, do a google search - just on this site - for CashNet. If I'm thinking correctly, they are licensed. If so, it needs to be handled differently than a non-licensed pdl.

I'm calling the AG office tomorrow. I believe they are but under a different name of the finance company.
I dont recall. But we will sure find out.

There are several templates for letters on here that we acn find by searching in the google box...but wait until you know if it is a legal pdl or not before you decide which one to use.

Good afternoon forum,

I was able to speak with someone at the AG office to confirm if Cashnet USA was licensed in FL, well the answer is NO. They have many companies listed under the name but I pulled the names listed on contract, which where:

CashnetUSA
Cash America Net of Florida LLC
Capitol Corporation Services Inc
NCP Finance of Florida LLC in Ohio.

There is a PD company listed in Chicago as Cash America but not in Florida so they are illegal to operate with the Florida State.

For all that live in Florida, you can fax a compliant aganist any PDL that does not have a license and they will work with the Company and can even provide a refund. How about those apples. The fax number is:
850-413-1551 Attn: Consumer Services (Banking) and
once they contact the lender, they have 21 days to responsed.

My orginal question was, once I default how do I begin to request a PIF based on: do I have to default or can I ask for the PIF now,

5 loans = 400 X rollover fees of 100 each
6 loans = 900 X rollover fees of 225 each.

Great work, queen! I'm sure MANY people in Florida will be interested in that post! I hope Frogpatch sees it, as he's in Florida also. As for your question, I've found (just my opinion here!) that the pdl's are more willing to work with you once you've defaulted. If they can not access your money any longer, they have no other choice but to correspond with you and try to find another way of getting "their" payments. I, personally, stopped the debiting of my account, then sent the letters stating that I overpaid, posted my state law, told them the amount of the overpayment, and demanded a refund. It worked pretty good for me. In the beginning, I was getting refunds right off the bat. Now, others may use different tactics. I'm just telling you how I did it. And, did you ever find a "sample letter" requesting a PIF?

I will let it default because like you said it would be better under my terms. BUT, if you where getting refunds and now they are using othe tactics, which would be?

As far as the PIF, I havent found one yet. I guess I can look at one of the blog.

So I am going to default first and then let them wait
for my letter. The AG office was so willing to take my case. He did say to try with them first, the funny thing cannr, no one has call me yet? weird.

Sassnlucy, hey -

Did you have any IPDL? The funny thing is I have defaulted on all of them and no one has called and my bank account is closed. Has anyone gone through this?
I read he forum of the horror stories and dont understand. Even Sonic, after they tried with my employer and they sent them to hell. They never called back. And they have the ba_ _ s to send me a email to reloan. Are they crazy.

Queen, Thank You!!!! I'm in Florida too and I have just defaulted with Cashnet USA. I didn't bother to really fight with them as I saw on Cashnet USA's website that they are legal to lend in FL so I agreed to a repayment plan instead of pursuing it any further. I think I just changed my mind. Please keep me updated on your battle with them. Maybe we can both win!

ald_ked with all the great advice from this forum why not fight. The AG office rep told me this afternoon that we only need to pay what we owe. These PDL are killing us with there fees and they are getting away with it. I bet you work hard and get paid bi weekly like me for someone to take more money away from us? And the way the rent is going sky high in Florida who would be pay it. And, just because the website says they are, I would not take that for granted. I have notice some of these PDL have 10 or more different company names. We all have to keep a positive attitude if not we are all going to get sick. I always say those who work in PDL in collections go home each night, eat dinner and sleep so why not us? But to tell you the truth it was dealing with the bank was worst, I can handle these clowns. See, queen? Your post has already made one person happy! ald is very excited! Thank you again for posting it! Go ahead and default. Like I said, they'll have to work with you since they have no other means of getting your money. So......they'll have to deal with you making payments, if that's the case. However, if you're saying that you've overpaid them, then they don't get any more money. LOL! Your AG is on your side and working on it. That is a huge plus for you. As far as a PIF letter - are you asking them to mark your account as PIF? Or are you wanting to show them you overpaid and demand a refund? Let me know which one it is you need. Or both? And - also - they haven't contacted you yet. Yes, that's eerie! But, believe me, they will eventually contact you. Sometimes these pdl's are SO SLOW at realizing what's happened! It's actually funny! I think it's all so "automated" that they don't catch on until after a while of not getting payments. So, queen, give them time and they'll come calling on you! And, don't let them get you down. Shoot, I just got an email today from a pdl that, I swear, I haven't heard from in 2 months! I was like "What the?" All of a sudden there's an email from them out of the blue saying they received my "letter of complaint". Oh, okay..... Weird is right! Let me know your situation. Whether you're looking for a PIF or a refund.
