I know I only show up to vent anymore. I have been busy. So here is my latest update.

as for PDLs, haven't heard much from them. Just the occasional message left on my phone, and a few phone calls where no one is on the other end right away so I just hang up, knowing it is probably them.

Here is my latests 'egads!' Got a message from a friend saying that my car loan is calling asking for my address. My address? They already have that, that is where they send my bill! Oh wait that means they are thinking about taking my car back soon. I'm freaking out. I'm only 2 months behind now, but they have the right to... doesn't matter how far or how near behind I am.

Just needing to vent, as I usually get some good words of support.

Poko, vent away if you have to. Did you call rregarding the car to see if you can work something out with them?

I'm going to call them this afternoon. I know it is the only way to get it taken care of. But I hate talking to people. They like to harass. Or worse they are nice and seem like they want to work with you and then they don't do what they say they will. But I'm only basing this off of experience....

And I'm not really in a position right now to get caught up, I'll barely be able to make arrangements just to keep at my current level. All I know is I can't have my car taken. And I don't think I'll get enough back in taxes to make even a dent, I might just get enough back to pay off the tax person.

OKay so I called. And of course... YAY! It did wonders.

So lesson the first: call them, and work something out...

I called to let them know when to expect their next payment, that I could pay extra and would try to get caught up. The lady was very nice, asked why I had gotten behind. Then she offered a deferrment. So of course it is more expensive in the long run, because I only took my two 'late' payments (jan and feb) and moved them to the end of loan. But I still had to pay my late charges and fees. But I don't have to worry about the car now until March. So all is well.

Some not so fun news....

My transmission just went out. While we were driving on a snow/ice covered road. The good karma we received from helping someone a bit earlier get unstuck from the snow helped us not roll our car and die, because we went flying off the side and into the sagebrush. The car wasn't damaged (with the exception of the transmission of course), and neither were we. So that is good.

I owe my dad a lot of money now. I consider myself very lucky to have the family I do. I'm very lucky neither of us were hurt. It would be instances such as this that would be good to have money save. But I don't.

And remember people, get everything checked out in your car, spend that money to make sure it is safe and won't explode on you, because that costs way more in the long run.

The funny thing is, if I had hurt the car in anyway, I could get an insurance claim, especially if we had rolled... Horrible to think right? If I only had been almost killed then I wouldn't have to worry about that car ever again.

But yes, we are fine. B was crying today because of our current financial situation, and she never cries. She went and talked to the landlady. When she came to see me (and bring me lunch how sweet), she said we were getting an eviction notice. I just about died. But apparently the landlady would write us one so that we could use it to get help essentially.

B also went into the community college outreach here and looked into getting into nursing classes. She applied for financial aid and all that. She's also going in to check on a summer job. Also I just got a cost of living increase and my actual raise will be on my next paycheck. So things are looking up in general, but there always has to be something to make sure we know life isn't easy.

To those on here that seem like they have info that can help, currently have loan with cashnetusa, loan point, ezcashmedia, mycashnow, and one in town locally quick check. I already have two checking and two savings accounts don't really use the second one right now, 3 of our paychecks are direct deposit, we are in Oregon and bank at B of A, right now checking account is negative (thanks god they paid the rent the check) have $500 worth of fees coming out tomorrow, and one full loan that will is dated tomorrow and will clear tuesday or wednesday. Needless to say our deposits are not going to be enough to clear up the negative balance and pay the achs that are going to go thru tomorrow, so depressed by all this can't sleep, some people are saying to close accounts some I have seen use a place call langhorne debt solutions, which differs in opinion if they really help, am totally drowing, can't sleep, and on anti-depressents, can anyone help me!!!!!

I believe loan point and Ez are illegal. I know MyCashNow is.

You really need to close the account but BoA can be hard to work with. Even if you close the account when the ACH hit they will open it back up.

You have to be clear that it is to close and not reopen.

Many posters here have had major problems with them. The only way that some were able to get help was to file a complaint. My best advice to you is to speak directly to a bank manager. Do not take no for an answer.

You have the legal right to revoke any ACH three days before it is due to post. Write up your letters to the illegal PDLs. You can find an example here. Scroll to the 13th post to find it. Change the information on the letter to reflect your information and state laws. The letter includes the ACH revocation and wage assignement revocation statements.

Take them to the bank with the federal law that states you can revoke the ACH. You can find that here under 3(c).

Tell the bank manager that you have been dealing with these illegal lenders and although you have sent them those letters they are still debiting your account illegally and you want it closed down to stop them. You want it frozen solid. No ACH withdrawls what so ever from any company.

Do not take no for an answer. Demand they close it. It is your right and if they don't you are going to report them. Be ready for them to deny your request and give you the run around. Stand your ground.

BoA are horrible when it comes to these things.

If you want to open a new account with them then that is your right but I suggest you find a new bank.

After the account is frozen/closed then send out the letters to the PDLs.

If you send the letter before your account is closed they will debt many times each and for all kinds of amounts.

For the legal lenders. Once you account is secure you can make payment arrangments with them.

For the illegal lenders you only owe what you borrowed. Any fees or rollover charges go toward that amount.
