Just found this thread from a while back:

It seems like they have a clause in their contract that says they are authorized to debit any account you may have. Similar to Geneva Roth.
Don't know if this was covered in the other threads but I thought I'd bring it to your attention.

I think I did mention it. I also think it may be a pretty common thing for these people to include in their contracts. How they find the new account info remains a mystery to me. Boy Jen, this is really a topic that touches us all.

It's actually pretty common that the contracts have that in it. Most of mine did. But none of my new accounts have been hit.
Really, you have a better chance of being hit by a car.

OK..Eastside Lenders have a claus in their contracts to debits any account you may have...they still need your new account number. Certainly the bank wasn't sent a copy of your contract??? So how are they getting this information??? Banks should be alert to this...before continuing business as usual.

It still baffles me how they are getting the new account info, no doubt they are doing something illegal to obtain it. But not all PDLs have this clause in their contract, I just reread through the MTE contracts that I have on my computer (Oneclickcash and UnitedCash loans) and there is not clause stating that they can debit ANY account, only the one you gave them permission to debit. It only says if you send them a check with a new account number, then they have permission to debit that account.
There is no doubt in my mind that sooner or later, the majority of the PDLs will be putting a similar clause in their contracts to debit ANY account you may have.
