I need help in Florida

PostPosted: Sat Oct 27, 2007 10:53 pm Subject: I need help in Florida

I currently have 6 internet payday loans. This is a vicious cycle. Can I close my checking account before the 31st to stop them? I'm at my wits end.

CashNetUSA - Original Amt $500.00 - Paid $119.75
UnitedCashLoans - Original Amt - $500.00 - Paid $105.00
NationWide Cash - Original Amt - $500.00 - Paid $400.00
ZipCash - Original Amt - $300.00 - Paid $95.00
AmeriLoan - Original Amt - $500.00 - Paid $360.00
Cash Transfer Centers - Original Amt - $300.00 - New due on 10/31.

Any advice would be helpful. I don't won't to get into bigger trouble by closing my account if I shouldn't but I need to do something before I lose my house.

Relax, some of those are illegal companies, meaning you legally do not have to pay them back. Keep checking back. Some members will post the specifics soon. Come back and keep checking.

Bud Hibb's website covers these clowns, too. He has the whole list of worst collectors.

Read this first before closing your account: http://www.debtconsolidationcare.com/paydayloan/close-account.html

Close your bank account as soon as possible. If you open another make sure it is at a different bank. make sure that ACH debits won't force open your account.

After you close your account, you will need to call the legal ones and set up payment arrangements with them before they default. Cashnet Usa is legal. They operate as a CSO in Florida. They will try to tell you that they can only do ACH debits for payment, but hold your ground. They do accept other payments.

Ameriloan is illegal. Legally you do not have to pay them back anything but most of us pay them back at least what we borrowed because we did use the money. Going on that you would owe $140.

I am not sure on the others whether they are legal or not, but someone else will be by that can answer that. Always concentrate on the legal ones before the illegal ones.

Sorry you will also need to send ACH revocation letters and Wage assignment revocation letters to all of them after your account is closed. I am going to pm someone who has a good letter that you can use and have them pm it to you.

From what I understand, the pdl would have to be licensed for Florida residents. Correct me someone if I am wrong. CashNetUSA, as pyb pointed out, will be licensed/legal. United Cash Loans and Ameriloan are d/b/a's of MTE Financial, they will not be licensed/legal. Cash Transfer Centers is WAY illegal. They are overseas. Hang on and we'll get into that more. I'm not positive about Nationwide or Zipcash. So, anyone who knows if Nationwide or Zipcash would be licensed/legal for mrobinsdon, please post. You want to close your account and prevent these pdls from hitting by the 31st? I honestly doubt you can get it closed totally by the 31st. You're cutting it way too close. However, you can go to your bank - go to the branch where you opened the account - speak to the branch manager only. No one else. See if they can get it closed for you. They will have to assure you that your account will not be "forced open" due to pending pdl debits. Because these guys are going to be ready and waiting to hit your account. It might force the account back open. If they can not assure you (and if they do, get it in writing) that it will not be forced back open, you will need to do a hard debit block on it. Tell them NOTHING is to go through. This means no checks from you, your ATM card, nothing. It'll be blocked. You need them to do SOMETHING so that the pdl debits do not go through. Now, Cash Transfer Centers, you need to do a fast letter revoking any wage assignment you have signed. Do it NOW. All you have to do is type up a very short to the point letter stating: "I (state your name) hereby revoke any and all wage assignments I may have signed with your company, your partners, or any affiliates." Type your name. Your done. Put their information at the top, of course. Do this NOW. They will send a wage assignment to your employer. Email it/fax it/mail it certified. NOW. You must revoke it before they send anything to your employer. You are going to have to contact CashNetUSA, as they are licensed/legal, so you have to pay them. As pyb posted, they apparently will take other forms of payment besides ACH debits. Be firm with them. You need to get your bank account straightened out FIRST. This is the very first step. You need to make sure your money is taken care of, the pdls can't hit your account any more. Then we can start sending out letters. You do not want your pdls to know you are even THINKING of closing/blocking your account. If they catch wind, they will be all over your bank account like vultures. Do not breath a word to the pdls yet until the bank account is taken care of. Now, go to your bank ASAP in the morning and get this done. Like I said, you're cutting it awfully darn close. Either get it closed with assure in writing that it will not be forced back open or a hard debit block on it. Once you do that, we do have a letter for you to send to your pdls. But you need to do this first. Go to the bank, type the revoke letter to Cash Transfer Centers, come back and post what's going on with the bank. Then I can pm you a letter to send. However, you don't need the letter yet. You don't want to send it too soon. Please go to the bank first and post what's going on. Then we'll go ahead and proceed further. Also, do NOT forget to do that letter revoking wage assignment to Cash Transfer Centers now.

Don't send anymore letters until your account is taken care of. If they get an inkling of what is going on they will hit your bank acount early. Once your account is closed then send the letters.

Does anyone know if these two are legal?

Nationwide phone # 866-808-0936. I don't have an address for them but on their website 'nationwidecash.com' they say their headquarters are in New Mexico.

Zipcash-SFT, LLC

Some members have different views then me. I would not pay back any money to an illegal company. You legally do not have to pay them anything. It comes down to your choice.

Absolutely.......I feel the same way. The ones that are illegal will not be getting paid. I need to take care of the legal ones and at this point that is all I can do.
