Delaware Attorney General tells me...

Eastside Lenders(of Delaware) does not have to follow Oregon law when loaning to me (I'm a resident of Oregon). The Oregon Department of Finance and Insurance has told me twice that this is NOT the case. The person who called me from the Delaware AG's office today said "she'd never heard of such a thing" when referring to have to follow some other state's law when it comes to payday lenders in Delaware, and that "she's been doing this for a very long time". No wonder Eastside Lenders says that they are "prepared to go to arbitration". I've offered to pay back the remaining principal, and they're still insisting I owe the full amount including the 995% interest.

Hmmm.... Is this complacent arrogance that comes from being the usury capital of the United States of America? No wonder banks flock to Delaware. Shocked

First off, Oregon's laws specifically say otherwise. They specifically state that any company lending to an Oregon resident, over the internet or phone or fax, must comply with Oregon's laws.

Did you file a complaint with Oregon's attorney general?

yes golden,the delaware AG told me the same thing in regards to eastside and GECC aka CASH DIRECT EXPRESS.
incredible.of course my AG in illinois had a different point of view.

I'm sure the AG is looking at it as though these places are stil doing business in DE. They aren't thinking of the transaction as though it happened in your state.

Once again, I see cases like this one forcing the US Supreme Court to decide which state laws are followed: the ones where the lender is or the ones where the customer is?

hmmmmm...I know there are laws to protect the consumer from businesses, but are there laws to protect businesses from consumers?

Goudah - No, I just filed a complaint with the ODFI (Oregon Dept. of Finance & Insurance) as you reccomended.

In Oregon, the ODFI does a lot more then the AG's office . . . . But it may be worth it to file a complaint with them too.
