Cash Wink is only licensed in DE, they do not have a TX license and are not a CSO.

Okay. I'm Looking over some of these and like for Nationwide Cash. The principal was 400$. I have payed back 407$ and still have the 113$ in a last payment due Friday. If I'm reading correctly then because its an illegally done and has nothing about being a CSO anywhere on the contract I've paid the principal and do not owe them anymore money.

Now I have a bigger problem. Reading the bank statements the rent check bounced and i haven't gotten the notice from the complex yet. I'm expecting the eviction tomorrow. Does anyone happen to know a bank who does legal loans and works with bad credit.

I sat my son down to tell him the full situation and that I have reached out to this community for help and advice and he brought up an odd an interested point that I would like another opinion of factual thoughts on. I told him that that the majority of these pdl places were automatically taking there premium out of my paycheck on the payday that it is deposited on. He looked at me said:


"If there an illegal company not licensed to lend in the state of Texas, or for that matter the country, Isn't taking the auto-deductible from your pay check against the law or at least a breach of the FDPCA in which the bank would have to refund the amounts from the illegal store. Granted the bank doesn't know that the amounts are being paid to a lender who isn't licensed in the state / country but if you brought that to there attention wouldn't they be required to stop payment, lock the account from further withdrawals, and refund all seized amounts from the illegal companies? No doubt in my mind we would have to pay them back, but because of the circumstances wouldn't we have the option to pay back the illegal lenders at our discretion? Even at worst the Illegal lenders can't put a lean on your credit because that would be admitting they lent the money to someone when they aren't licensed to on top of making it a public record that they broke Federal and State laws by doing that."


Really looking for an answer to that question. Because if hes right or at least somewhat in the ballpark of being convincing I could get about 1300$ back and pay the legal ones or at least make payment plans and then start working on the ones that are illegal. Any info or insight on this subject would be a great help.

No, unfortunatly, the banks wouldn't be required to do anything. It's not their concern if the company is legally licensed or not, their only concern is if the charges were authorized or not.

You could dispute the charges, but if the company can prove that you authorized it, they will stick.

Also, the fdcpa is for third party collectors, it doesn't apply to the original creditor.

Isn't the ACH processor considered a third party party collector if i'm not writing the check directly to the place i borrowed from.

Payday One is fairly decent to work with, I didn't have too much of a problem negotiating with them.

Well i try contacting the lenders and they refuse to give me a statement saying how much i still owe them or how much ive paid period. Wouldn't i be able to take some action at the bank when there not letting me know how much i owe?

Im sorry for your situation...

but why would you think your landlord would evict you for one bounced check? I would think they would at least try to give you an option to make it up.

you are sooo right! Paydayone was easy to work with. They gave me an easy 4 mo. payoff plan AND I don't start the first payment until the 22nd. I have two more pds paying off on Fri. then I will be DONE!! There is light at the end of the tunnel and boy did I learn a BIG lesson!!!
