Flames, you REALLY need to work something out with your legal ones so that you can close your bank account before your next payday and stop the illegal ones from taking all of your money.

Did you give a post dated check to the store front ones? I've seen some people on these boards advise against closing your bank account before working things out with store front lenders because it's possible that you could get in greater trouble for writing a bad check. However, I've also seen others say that PDLs can't prosecute you for that. So maybe it depends on what state you are in.

But somehow you need to get that bank account closed, even if it means going back to the store fronts and explaining that you've had to close your bank account due to unauthorized activity. Maybe they will require you to replace the check with one from your new account (if you gave them a check to start with), or maybe they will be willing to make other arrangements with you.

Also, in some states, if the store fronts are members of the CFSA, they are required to offer you an EPP (extended payment plan) as long as you go in and request it at least one day before your due date. That would allow you to pay them back in four equal payments, with no extra interest added on. I don't know whether that law applies in your state.

Well They wont give me the statements to tell me how much i owe on the illegal ones so now the account is over drafted and i have nothing to do. The complex i'm at works with people with bad credit. You miss the payment they file the eviction. My only real option now is to borrow from friends while i go to the bank and dispute the 1300$ taken from my account.

TY guys soooo much. The legal ones are paid off and i have my new account and things are going smoothly for once. The illegal ones are still a problem though. I request the statement, contract, and proof of license/CSO but all they just send me more harassing letters or emails or the dreaded phone call from people who dont know anything.

My son stepped up for me so i owe him credit for that. But i dont know how much i owe each one. I know its best to pay back what i owed, but with out the statements saying how much was already paid i dont know how much to send them. Any advice on that or just send them something? My son said he called them and requested there proof of license or CSO certificate and sence then theyve kind of stopped calling and im just getting letters like "We will settle for 50% - 70% of your current debt". Im not sure if he scared them or if there just impatient.

I have another problem with these people now. Payday loan yes hired a firm and is threating to send to send the complaint to the district attorney. Can they do that or?

well the woman i spoke to at the firm was real intent on getting me to pay 700$ to pay a 350$ loan when 315 was already paid. The amount in the contract i was supposed to pay back was i borrowed 350 i pay back 410. But i lost the check book and on top of the pre autherized payments someone wrote hot checks. (check issue resolved) there saying i defaulted and now want 700$ more on top of the 315 already paid.

Oh and there saying because the debt is 700$ and they have a "hot check" (i never sent them a real one) that its a felony so its a criminal matter cause its a theft of over 500$. But i was told earlier that the loan wasnt legal in texas to begin with so i dont know what to call and tell this woman and shes expecting a clal by noon.

Record those calls if you can. Leverage for later. It is not a felony, it is not a prosecutable offense. Is this the OC or a 3rd party collector?

Its neither. Once i received the call i called payday loan yes. The man on the phone told me "The account is past due and a law firm bought it." The woman who called claimed to be from a law firm just stating she was going to send it to the attorney general. The man at payday loan yes told me i had to talk to them because they were no longer allowed to do anything reguarding the loan. So im not sure if you would qualify them as a 3rd party collect but its not the OC.

Sounds like a 3rd party debt collector. They are bound by the FDCPA. File complaints with the TX AG and the FTC. Do you have the phone number they are calling from or they want you to call? I'd like to see if I can find out who it is calling you so we can determine who the players are.

Phone number is 877-777-2551. The woman mumbled the name of the law firm. They called me. Left me that phone number. The woman's extension and the case number regarding the debt. i told her i wanted some info. She told me to call payday loan yes. They told me they cant release anything to call her.
