I have had calls from Bill Starks, Sherry and Chris from this "law firm". This morning Chris called and I told her I was still waiting for verification of this debt and she said she would fax it. I asked that it be mailed. She says "so you are refusing" to take care of this. I said I just refused a fax. She threatened me with jail and that I was breaking federal laws from one state to another. She was just going to recommended legal action. Today she said they represent paydayloanyes. Bill Starks said it was paydayoneline.com. Do they really know?

Has anyone else had contact from this "law firm"?

I searched this and found out that they are in Florida. What state are you in? We need to see if they are even licensed to collect in your state.

those two names,bill starks,kristin or should i say kristy swanson,sound familiar.i thought i saw there names on other topic posts.maybe a CA changed names.i just can't help but seeing those names on this sight before.

Now I remember that you are from KY. Sorry, I did forget for a moment. You know that all she is doing is throwing out idle threats.You know that you will not be going to jail. What we dont know is if these people can even collect in your state. I would bet NOT.

I normally don't even answer their calls but I get tired of hearing the phone ring. I have paid so much to these PDLs and almost lost my home so what she is threatening is almost comical. If they are legit why would they not have sent communication in the mail. She even asked for my address. There are so many holes in their stories. I have actually gotten educationally stronger from this forum on these guys and they are really lost as to what to say when you actually know what you are talking about. I don't know everything but I do know that you don't get a phone call telling you you're going to jail. Sorry to go on and on but I have had about enough from PDLs.

No I did not mail it to them but I have requested this everytime they call and (there are 2 of them calling me) and have yet to receive anything. The packets I am making for them include this though.

I was working with Langhorne and they do not request validations of the debt. I am not sure what they get from the PDL but they come up with a settlement offer.

Debt Validation really needs to be requested in writing....otherwise its your word against theirs, which it sounds like is happening now...and actually I think the FDCPA does say it has to be in writing to be enforcable.

This is not a request for "verification" or proof of my mailing address, but a request for Validation of Debt made pursuant to the above Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.

1. What the money you say I owe is for
2. Explain and show me how you calculated what you say I owe
3. Provide me with copies of any papers that show I agreed to pay what you say I owe

7. Show me that you are licensed to collect in my state

At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major credit Bureaus (Equifax, Experion or TransUnion) this action might constitute fraud under both federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent, I will not hesitate in bringing legal action against you for the following:

1. Violation of the Fair Credit Reporting Act-reporting inaccurate information
2. Violation of the Fair Debt Collection Practices Act-continuing collection activity on a debt which has not been validated

Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes listing of any information to credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.

REQUEST FOR CEASE AND DESIST OF CONTACT BY YOUR OFFICE: I would also like to request, in writing, no further contact, either in writing or telephone be made by your office to my home or to my place of employment, unless it is to provide validation or release of liability of the debt.

motomom, go ahead and send the debt validation volley posted if you have an address for these jokers. This way you will have more documention to back yourself up. Keep everything you can in writing. However, just rest assured, they can do NOTHING to you, honey. They can NOT collect on this debt. Per our Department of Financial Institutions, this is not a legal debt. So, no, they will not be licensed to collect, no, this is not a legal debt, no, they can do $hit to you except try to harrass the living crap out of you. Honestly, motomom, that's all they can do is call you and give you idle threats. No need to be worried. Illegal debt - can not be collected in our state - period. Just watch out though. They might throw themselves on your credit reports, but you can dispute it and have it deleted. Otherwise, no worries.

Please if you are having problems with this firm. Contact the BBB. I did and they are not operating within the Law. They even went so far as to lie to the BBB when confronted with thier ILLEGAL collection practices. This guy Joshua called me and threatned to sue me for a credit card debt that belonged to my aduld child that was in college @ the time she got the cc. He had my ssn and everything.He had my new phone number that could not have been listed by my daughter 3yrs ago on the cc aplication because my # has changed. He was very specific in threating to sue me. When confronted by the BBB they straight LIED in the response. They sent a half-ass letter of apology through the BBB saying it must have been a misunderstanding. I understand when someone is dishonest and trying to use threats to collect money illeagally. My complaint will stay on file for 3yrs with the BBB. The best way to get them in line is to report them. They will not be able to keep this up if enough people report them.

I'm glad I found this site. I got a call from a Mr. Lopez asking for me to call him back. After looking them up I realize they must be calling for paydayloanyes.com where I took out a loan. I paid most of the loan back and then missed a payment. the next time my payment was due they took out 3 payments.. which should clear up the loan. They then said I owe another $140. When I asked for a verification of what was paid and etc. the guy got frustrated with me. Fortuanlly all contact with them was through email... but I plan on sending in a debt validation letter. Does anyone know their address?
