Have you contacted your state's labor board? They may be able to step in and make the company give the money back. It's illegal for an employer to withhold money from your check without your authorization.

No I don't believe she has done that yet. She is going to speak with our Wage an Hour attorney, the one I work for before she does anything else. I should know the outcome this morning.

Yeah, you really would! The problem is that wage assignments are not well known. Most people have never even heard of them. So HR sees it and assumes it's legal.

Update and good news. The wage assignment issue has been resolved. The firm is not going through with the assignment, which made my friend very happy. Thank goodness the wage and hour attorney resolved the issue. It is voluntary and the company does not have to honor it. In this case, the HR dept. was wrong in their holding back the wages. So sometimes there is a positive end to a bad situation. My friend is very happy. Once again, thank all of you for your help with this siutation and I have encourage my co-worker to join this forum as it has been a wealth of knowledge for me.

I am on the site regularly. I actually have sucessfully used this information from this site and from my work experience to deal with One Click Cash. Evidently my complaint to the DFI of Nebraska was the straw that broke the camel's back and the issued a Cease and Desist on this company. The hearing is set for October 29th and I cannot wait to find out the ruling. Hopefully it is a favorable one for the consumers who have been screwed by this company. Once again, thanks for your help and will definitely be around the forum.
