I currently have 6 payday loans out and am drowning. I read the information in previous posts and now understand that most of the companies I'm dealing with are illegal and that Florida not only allows for only 1 loan but they do not allow for rollovers. What do I do and how can I stop this??

Any help would be greatly appreciated

Florida is known to have CSO's (Credit Service Organization), if any of these companies listed are CSO's, they are 100% legal in what they charge and would not be obligated to follow the laws below. I'm not possitive about ALL of your lenders but I do know there are a few that are NOT legal ANYwhere.

I hope the information below will help you.
You are only obligated to pay back the principal amount you borrowed from an unlicensed/illegal Internet Payday Lender. If you follow the steps below for the illegal lenders only, you should be fine. I am unsure of CashStarGroup and 247Advances. Keep checking back, perhaps someone else may have info on them.

thank you soooo much. I have contacted my bank and we are working together to determine whether to put the hard block or just close the account. the branch manager is working on this and will be getting back to me. I will start preparing letters as well. Thanks again. I feel like i might be able to start breathing again!

Florida section 516 states that all lenders must be licensed in the state regardless of their location. If they are not licensed then the loans are non collectable. You can start breathing. PM a member called Floridaconsumerlaw for more info. You can find him by doing a search above.

Can the payday loan companies send you to collections? Based on the last reponse i'm assuming no but wanted to double check

A payday loan company can send it to a collection agency but if the loan is illegal then so is the collection on that loan.

They can't garnish your wages if they are illegal.

Legal paydays usually have inhouse collection divisions but sometimes after a year or two will sell it of to another collection agency.

A co called my work today threatening to contact my work and do a wage assessment. They cannot garnish my wages on an illegal loan can they??

You need to revoke any and all wage assignments you may or may not have signed with EACH lender, then show a copy to your employer. If you re-read the steps above it explains.

Wage assignments are illegal in Florida but most employers are unaware of that. Follow Shazzers advice above to be safe!

ok they won't tell me which company they're trying to collect money for. They tell me that I owe $400 plus some $15 fee but I didn't borrow $400 from any of the companies.... SO, I found the debt validation letter on here and sent that to her along with a cease and desist and revocation of wages.

If you get harrassed in any way by a collector or any other FDCPA violations like 3rd party contact, contact during the validation etc. I can provide you with an attorney who will work on contingency.

I'm being harrassed. I've sent the letter twice to them. the supervisor just called and yelled at me. i explained that i sent the letter and she was extremely rude telling me that no lawyer can help me. I tried to ask if they were licensed and they said yes. I tried to ask what company they were trying to collect for and she wouldn't tell me. Can I please have the name of the attorney?
