Hi, I just found this forum, and I am in a payday loan trap. I make over 65k a year, and I am just sick over this. My Husband was out of work for surgery, and I used payday loans to get by, what a mistake!!! I have not yet defaluted, but I am about to lose my cars, and other stuff, I cannot keep up, and I called BOFA to see if I could close my account, then deal with these companies one at a time and pay them off, but BOFA said my account will just reopen once the try to do the ACH? What should I do????? I live in Florida. These are all internet payday loans.

Oh dear, I do know from reading other posts from other members that BOA is VERY difficult to deal with. Speak to the Branch Manager and tell them you want a HARD DEBIT BLOCK placed on your account asap! Tell them you are dealing with a possible stolen identity, perhaps that will make them act faster! After you have your account secured, you need to send letters to each and every one of your lenders and tell them you are revoking their right to debit your account, also tell them you are revoking any and all wage assignments you may or may not have signed. FIRST and formost, insist on having your account FROZEN so there will be NO more funds coming out. Tell BOA you have revoked ALL ach transactions in writing to these companies per the EFT Act (regulation E). They (BOA) MUST abide by this law!

I need to check on some of your lenders to see which are legal and which are not but I can tell you right now you have quite a few that are NOT legal, therefore, CLICK HERE to find out how to deal with illegal lenders.

Florida requires internet based pdl's to be licensed by your state BUT, FL is known to have payday loan companies acting as CSO's (Credit Service Organizations). This means they do not need to be licensed, and are generally 100% legal in what they charge.

Thank you so much for your response. As I have stated I am not yet in default with any of these companies, and I can pay the loans back within 2 months, (If I could just get away from all the fees every time I get paid). I will go into the bank tomorrow. They were unable to help me via phone.

All that you are obligated to pay back the illegal ones is the principal amount you borrowed, I would not give them a dime more!

Please keep checking back for more information from others, they may be able to give you advice on how to deal with BOA. Also, if you type the names of the companies in the search box located in the upper right hand corner of this forum you can read what others say about them, find their addresses, and may even be able to find out if they are legal lenders or not.

Is the second lender you have listed actually called Geneva? If so, they are also illegal.

I beleive that USA Cash is a part of MTE which would also make them illegal but I am not 100% possitive, perhaps someone else could verify this.

I also think that I Advance Steph is affiliated with Cash Advance Networks, if I am right then they aren't legal lenders either, but again I am not 100% possitive about that.

I've neevr heard of Midlantic, I searched for it but came up with no results, are they a payday lender or installment loan outfit?

Question.... What if I cannot get bank of america to help me and freeze or close the account? I have 2 accounts with BOA. One I used only for payday loans, and is in my name only. The other account is mine and my husband. Can they get money from that account?? I have stopped my direct depoist. But I will get fees if BOA will not cooperate. Do I still send letters to the companies that I have way paid off my loan due to all there weekly fees, even though I have not yet defaulted?

A more experienced person can probably answer this better BUT I noticed in some contracts it says they have the right to debit any account you're connected with. However, I never used any of your lenders so that may not be the case with them. I would send a letter to every company

Well I have officially decided that BOA SUCKS!!! They will not put any holds on my account. I can close it but it will reopen as soon as the PDL compaines try to get their $$. Then I can close it again, only after I pay the fees that pile up!! I think you should be able to close an account with out having this problem. I really do not know what to do now.... Has any one else delt with BOA? What did you do?
