Question for you Florida Payday Loan Experts

As I have said in my previous posts, I'm dealing with East Side Lenders right now. THey sent me there license number (which doesn't match what the state site has btw). I'm trying to come up with a reponse to them. What are the guidelines for FLorida in terms of internet payday loans? Do they have have to be licensed in our state to do business with residents here? I would love to quote something to them to throw this back at them. I have already overpaid the loan by almost $300 so they aren't getting anymore more money.

Thanks,
Jeanell

They gave me 8673 in Delaware. The state of Delaware lists a different number for them (I don't have it in front of me right now).

The state of Florida requires all lenders of small loans to be licensed in the state, regardless of their geographic location, under section 516 of the Florida Consumer Finance Act. Iy also states that any loan made to a Floridian by an unlicensed company is legally not collectable. You should file a complaint with the Florida Dept. of Financial Services. www.fldfs.com Also please write to State CFO Alex Sink and inplore her to take a more aggressive position against internet predatory lenders. I have sent her two letters both of which went unanswered. I have asked several other Floridians to do the same. Maybe that will get her attention.

Isn't that interesting. I'm looking and see:

East Side Lenders LLC
License Number 2001270
314 East Main Street Suite 304
Newark DE 19711

What the heck is this number she provided? However, as frog posted (and he is in Florida), the lender must be licensed in Florida. So whatever East side says is their license number (and I guess they don't even know) doesn't matter, as they are not licensed in Florida.

There is a quote from an email I received from the FL DFI here:

http://www.debtconsolidationcare.com/paydayloan/explain-pdls-laws.html

Quote:
She can file a complaint through our website at flofr.com and under 'helpful information' click on file a complaint. Then click on
finance related and you can download the form. Or click on money transmitters and call the 1-800 number. The Office will review her complaint when received. All lenders must be licensed by Florida, regardless of location, however, the current payday loan laws in place do not address internet businesses. The department is currently looking at other laws to apply to them.

She may also wish to contact Legal Aid in her area, to determine what recourse she may have.

If you have further questions, please contact this Office.

Thanks for your help. I just sent off another letter to the lovely Shaniqua basically stating that they needed to be licensed in Florida to lend to individuals in Florida and that I had overpaid my loan and considered it paid in full. Can't wait for the next response.

I have already filed a complaint with the Office of Financial Regulation on all of the companies. I haven't heard a word back from them. I will send off a letter to Alex Sink about the internet payday loans. Maybe someday the government will get a handle on this and put them out of business.

Jeanelle,
They only tried to call me once or twice, after that, they gave up. I overpaid them also. I'm thinking about asking them for my money back. I'm wondering though, are they gonna take action in the future? Am I gonna get something from a court in the mail soon? Not really sure how to deal with these people when they stop contacting me! hahahah. I always thought that was the goal, for them to leave you alone, but they're like snakes, they hid in the grass and strike you when you least expect it.
Good luck by the way, I hope it works out for you.

submarinesailor - I know what you mean. BIG Ltd just stopped calling me. I wasn't taking any of their calls and letting them all go to voicemail. The ones that just won't go away seem to be East Side Lenders, Rapid Cash, Payday Loan Yes and Geneva Roth. I feel I do owe Rapid Cash and Geneva Roth something as I haven't paid back the principle yet. However, I have asked for addresses to send the money to and they haven't answered me. No answer, no money.

topping, that's my motto also. Wink Until you can give me a physical address to send payment to, no payment will get to you. Sorry. I don't "do" money gram or western union.
