Sub: #1 The insidious PDL drug

Well, looks like I’ve joined the dubious club of people who got in over their heads on PDL’s. Sigh.

Mine was through a series of unfortunate events (aren’t they all?) that just dominoed into the current mess. My mother passed away last Sept. and I used all available leave and my savings to go to to her funeral several states away. Not a financial disaster…yet. That came when my husband had a stroke in May and I had to take several weeks off work - quickly burned through the little leave left and in July my check was only 1/3 of what it usually is, but at least I did not end up owing them (That can happen).

The hospital he was in is an hour from home, then the phys. rehab unit was even further away. Two and three trips a day quickly burned up the little money I had. Even after he was released there were trips for outpatient rehab, prescription co-pays, and a special diet.

First I pawned everything I could find. Next I borrowed from family.
Then I did what I swore I never would do and got a payday loan. Like any insidious drug stopping at one does not seem to be an option.
I managed to juggle these eggs right up until this month when a direct deposit did not go through and it all came crashing down.

I live in Washington.
Companies I have loans with (all online, all currently in default) :
ChecknGo online
CashnetUSA
StarCash Processing (never applied, but they deposited)
PayDayOne

Original amount of the loan:
ChecknGo online = $400.00
CashNetUSA = $400.00
StarCash Processing / Northway Financial = $200.00
Payday One = $350

Paid so far:
ChecknGo online = $400.00 have paid $560.00 so far
CashNetUSA = $400.00 have paid $780.00 so far
StarCash Processing / Northway Financial = $200.00 have paid $360.00 so far
Payday One = $350 have paid $460 so far

Bank overdraft fees accrued due to multiple ACH attempts since 10/01/09 = $285.00
That account is now closed. There is an arrangement in place to pay them for the overdrafts.
I have already informed my employer to not honor any voluntary wage assignments and sent notices to all parties revoking the assignments.
Now I guess the battle begins to work out a payment arrangement.

So far they have not gotten too nasty, but when they realise everyone will have to wait and take what I can afford I expect that will change.

Found a bunch of great info here so far. Wish me luck.

Starcash processing is one several people are having a problem with, I know they are illegal and from what you have paid them so far I would be fighting for a paid in full.

From the looks of the list, they are all on-line lenders and I think the only illegal one on the list might be starcash.

ChecknGo, CashnetUSA and Payday One are definitely legal. Check n Go is a member of the CFSA (Community Financial Services Association of America), which means if you request an EPP (Extended payment plan) they SHOULD give it to you, I am thinking the other two also also an EPP. Click on the link below to read about the EPP, number 11.

I agree with Pinklady, StarCash Processing / Northway Financial isn't licensed to lend in your state. Therefore, CLICK HERE to find out how to deal with illegal lenders.

Just to update: I received a few calls in the 3 days since closing my bank account, two of which came to my work. I sent everyone a cease and desist letter limiting them to mail or email only.

So far only two have responded via email.

CashNetUSA promptly replied that they will honor my request and apologised if they caused any trouble at work. Which I thought was nice of them. Working on a repayment plan with them.

Check 'n Go Online sent a form letter stating they got my email and customer service would be responding within 24 hours. That was 36 hours ago. They also neglected to provide their WA license number yet again. Would like to work out repayment but they are not making it easy to do so.

I also spoke with my employer payroll person on the issue of wage assignment and she said they never talk with these people without first consulting the employee and they never honor "those inane wage assignment things" in her exact words! So far so good on that front. I gave her a written revocation just in case she wanted it.

The illegals ignored the request and continued to call my home. One called work and was told off in no uncertain terms. Northway Financial (?) threw a right little tantrum on the phone when they found my account was closed. Being polite and reasonable would get them much further with me. The guy was so busy yelling I couldn't get a word in about how I could pay them! I finally just hung up on him. In my work I see tantrums regularly - clue for you: yelling gets you nowhere.

In going back over bank statements I realised I seriously underestimated just how much I have paid out on these things, so am recalculating them all. It was fairly shocking when I started to see just how much this has cost us! I got behind on my mortgage to keep these loans current - how dumb is that.

Sounds like you're doing good; keep a log of all calls, e-mails, etc., you get from and make to the PDls', and get as much in writing from them as you can. And quit beating yourself up, you're not "dumb;" Just about all of us here have been in the same boat at one time or other and believe it or not, there IS hope! Hang in there and keep us posted.

OK, that clears up CnG's status. Thanks for finding that - you are better at digging on their website than I was!

I found their Small loan endorsement, too. So they are all shipshape and legal in WA.
