I just defaulted on my loans yesterday and prior to that I put stop payments on the checks I wrote. My next question is what do I say when they call? I am not use to me or my kids not answering the phone when it rings. Can we just tell them we want to work out a settlement without the interest charges?

Can we also tell them that future communication be by e-mail and they are not to call your house again?

Change your number and contact them. Tell them when you'll call and live up to it. Which ones are they? That will help us tell you how to deal with them.

One thing is for certain, ya can't change your work number, and most times, that is where these pdl companies call. My advice is, to remain calm and cool, as difficult as that is, it's really been my best strategy with them. I've had them scream, curse and make a horses a$$ out of themselves, but I managed to keep my cool. I also told them I was recording the call (I wasn't, but I sure wish I had now), because in Ohio you only need one parties consent, usually, they hang up immediately when I mention recording the call. Laughing

I thought any time you ask them to not call your home or job they are suppose to stop, apparently that's not true. I didn't want to change my number since I have had it for 15 years. Any other options?

The companies I am dealing with are:

1. Paycheck Adv-Short Term Loans - Borrowed $450 - Paid $860
2. (Check Advance) Valued Services of Anozira - Borrowed $400 -Paid $430.
3. Ace Cash Express - Borrowed $500 - Paid $640
4. (Check N Go) Southwestern & Pacific Specialty Finance - Borrowed $500 - Paid $880
5. (Advance America) Cash Advance Centers of Arizona - Borrwowed $500 - Paid $985
6. Pay Day Loan Store of Arizona - Borrowed $400 - Paid $440

All stores are licensed in Arizona.

Also, have you ever heard of a PDL settlement company called PDL Assistance? They are proposing to settle all my accounts for 70% of what I owe but their fee is 30% of my total loans. If my math is correct I stop the interest charges but I am still paying 100% with their fees, is that correct? Should I use them or try this with the help of this board?

Have you defaulted on any of these loans? Paycheck Adv is an installment type of loan? If these payday loan companies are members of the CFSA you can ask for the EPP (extended payment plan), which means you pay them back in 4 equal payments, but that is only if you haven't defaulted on them, and you must go in BEFORE the due date.

Does anyone else think he's over paid some of these loans, it look that way to me? I'm not good at math, that isn't my forte', someone jump in here and help me with these figures, please? I know for a fact that Advance America is--and I belive that Check'n go is as well. And based on what I saw, you have definately overpaid the Advance America and Check'n go loans.

CFSA only applies to payday loans, I think. Call them and ask them if they are members, I was also going to suggest going to the CFSA website and checking, but I just tried and it said the service is temporarily not working, as they are upgrading. Anyways, call and ask each one if they are members, and if they are, then tell them you want the EPP, if they're members, they have to let you get on the EPP. However, I am still very apprehensive about these amounts you've paid already, it really looks like you've over paid. You still have to pay interest in the amount of your state laws, but I think you're due a refund on some of those loans. Someone please correct me if I am wrong. BUT, if I am correct about you over paying them I have no clue how much you've over paid though), you really should fill out a complaint online to your BBB, perhaps they can help you get this resolved.

I just checked my contracts and I don't see whether they are members of the CFSA. If they are licensed don't most states require that they become members? Again, I believe I have over paid any way. So instead of asking for an EPP shouldn't I be asking for a refund? If so, what's the best way to ask?

Sir, what you might want to do is to change your home number so they can not call you at home. I am think these are store front lenders, you might want to try to work out a payment plan if possible. I am not good in math but loans # 2 and 6 should have been paid for already. (then again I might be wrong) Also call the BBB to see if they can help you out. Good Luck and God Bless.

The amount I am showing paid is just the total fees amount. I wasn't aware that if the amount of fees you have paid is more than the principle then you have overpaid and shouldn't have to pay again, is that correct?

So if I have overpaid I should file a complaint with the BBB, then write a letter to the storefront PDL and ask for a refund, is that correct?

Hold on! johnny, check your other thread, please! I put some information on there for you, okay? You need to read it. Also, these are STOREFRONT pdls. These are not internet pdls. You need to contact them. They are licensed/legal. They will not email you. They will call you. If they can't get ahold of you, they will call your employer, your references, and every other number they can find regarding you. You need to be in constant contact with storefronts in order to not get the phone calls. And, also the fact that they are licensed/legal. I put information regarding the CFSA on your other thread; however, I see on this thread that you've defaulted. You can not invoke the EPP if you've defaulted, so forget about that. Don't change your phone number. Don't avoid these people. Do not do that. You'll be number one on their "hit list" if they can't get in contact with you. You need to call them. Explain to them your situation and work out a payment plan with each one of them. Storefronts can do a number of things. They may turn you over to corporate for collections, they may turn you over to a third party collector, they may turn you over to an attorney to collect, they may let you come into the store and make payments. It just depends. But, do NOT confuse storefronts with internets. Storefronts WILL continue to contact you regardless. They will not email. You MUST be in contact with them. If it comes down to it, they could take you to CIVIL (not criminal) court. Please, contact these storefronts and see what you can work out. Also, please read your other thread regarding what you have paid. Because if you are taking advantage of the 3 extensions/rollovers your state allows, that's why you've paid so much on the Advance America, for example.
