Many people have been expierencing calls from this very rude, abrasive, pushy, shady company. I have been dealing with them for my mother over the past few days over her debt to Checksmart, and here is what I have found out and advice.

#1 The company was just bought by Mr and Mrs Henrion and used to be under the name Legal Mediation Practice. The Henrion's were not envolved in the origianl company. They even changed the name because it was misleading. I spoke with Mrs. Henrion today at her home when I was getting no where with the rude supervisors... Smartpages.com is wonderful!

#2 NO they can NOT arrest you, come to your job, red flag your SS# or anything else they threaten. This is a civil matter and with ANY civil matter NOTHING can be done, UNTIL a) matter is filed with the courts and b) a Judge issues a Judgement. Even then it does not include jail time unless you wrote a check on a closed account or closed your account before the first payment was supposed to post..then you might want to check with an attorney.

#3 I turned in an Internet FBI report on this company and within 30 mins the FBI rep called me. She stated that by the things this company is doing it is flagging as a Phishing company and that it may not even be actual H & P reps calling, that a phishing company will "hack" the Real companies numbers so it looks like the call is coming from there, they even give the right call back number, BUT when you call it the "hack" program flags ceartain area codes and re-routes the calls elsewhere.

#4 DO NOT send them copies of your D/L and Debit card. By law you are not required to give that, and they do NOT need it.

#5 If your debt is with Checksmart, and you try to call your local branch to pay it they will tell you they don't have your account and to call H & P....instead CALL corporate here are there numbers 1-800-837-0381 and 1-866-354-0567, Let them know the situation, the rudeness, the unreasonable requests. That you are not allowed to send H & P a money order through the mail and they want a bunch of extra fees. I got my mother in contact with corporate and she was able to Pay them Directly for only the amount she owed.

#6 Do NOT become a victim. If something sounds off, of shady it probably is. Verify your address, ask for a mailed statement, and hang up. Then use the internets resources and INVESTIGATE!! You will find many things out that are surprising.

#7 Report this company to all the appropriate agencies. AG Florida, your state, Federal Trade and whoever else you think might help.

#8 STAND YOUR GROUND, they are just people that can NOT do anything to you. Mrs. Henrion's exact words are "We are strictly a collection agency for Payday loans"

i have a question how do you file an internet FBI report? i am trying to report that number that harrasses me and all i saw was my "local" FBI address (well over an hour away!)

These people were harassing me about a family member. Using the number you gave they said they would take us off their list. We'll see if that's true... Thanks for the numbers, though. I wasn't even sure who was harassing us.

i've never heard of H & P Capital up until they called a friend of mine and left a messages for them about me saying it was in regards to a "statement". I honestly do not remember putting the person's name and number down as a reference for ANYTHING. They have not made ANY attempts to call me. I'm not sure of what I should do.

I was wondering if you can help me because i had a problem with this company. They too also told be that i better pay up or something bad was going to happen to me. i told them that i could not pay the entire thing i was willing to work with tem on a payment plan. After arguring for a while the agreed to let me make payments. I was also wondering if this is the same company we are talking about.... in jacksonville.
since then i've had to change my number and i moved. now i can't contact them to send them money b\c i lost their number. i do not want them to think that i'm skipping out on them and put in in jail... this company really scared me.... so i was wondering if they can really do that? i would really love the help.... thank you.

They can NOT put you in jail. Debt is a civil matter not a criminal one. They will threaten that and also claim they have a judgement and court cases but it is all false.

There is another thread about them in the Creditor and collections forum.

They are actually being sued right now.

What was the original debt for? Was it a payday loan? If so what was the name of the company? Also, what state are you in?

yeah it was a payday loan. i had several out there and i thought i paid them all but i forgot that one from payday loan yes... i think i made at least one payment to them and that was it and it has been at least two years and not this company calls me threatening me to pay or i will go to jail.. right now i'm only making the payments i can make but they are getting something a month thismonth they got $200 and next month they will get something. and i am in florida and so is H and P Capital i think they are out of jacksonville

paydayloanyes is illegal.they are not licensed at all.can you recall how much was borrowed total and debited total?being illegal you only owe the principle borrowed.if you paid that then you owe no more.i wouldn't give H&P another dime.at least not until you find out more.demand something in writing.then hang up on them.do not speak to them again until they send something.thatis your right.

I just filed a complaint against this company. I had already made arrangements with the company I dealt with to begin with. I have been trying to pay my debt. But the rep that I spooke with just was not listening to me. It was said that I could not make arrangements with the company. I had to pay in full by five pm today or get arrested. So, I did some research and I agree. I filed a complaint. I know I have to pay. I intend to pay. These people have to understand that if you are trying to clear your debt, you could at least work with them. You know.

I cashed a check from a company there through my company and it turned out to be a bad check. (Out of state.) Is this the same thing we are talking about? Could I be in trouble for this or should they go after the company that wrote the check? Please help.

Thank you for your input. They called me yesterday and said that I would arrested today. I did give them my debit card over the phone because I was so scared. When I calmed down I started to check them out and you are right they are doing nothing but too scare people. I did call them back and told them under not circumstances are they to use my debit card to take money out of my checking account.

They may do it anyway. I would keep a close eye on your account and if the debit then dispute it with your bank.

I keep getting calls from a woman for this company telling me that I need to call them. She also said whether I call or not a decision will be made against me. Very pushy, the first time I answered the call she went off on me and told me I was the rudest person she has talked to and hung up..Im like what was that about? Ever since then I dont answer when that number appears. They are very unprofessional, I have not received nothing in the mail from them so until then Im not giving anything
