I am currently in the state of idaho, and unfortunately got into the payday loan trap again, this time i drug my husband into it. I am owning almost 1300 total in payday loans, and there is NO way i am going to be able to get out from under these. I am considering closing my account and just setting up payment arragements with these companies. Should I do this? I just need some help, I am barely making ends meet right now with paying all these payday loans.

Thank you

Please list the names of each of your lenders (yours and your husband's), how much you borrowed from each, how much you've paid or been debited thus far and whether the loans were obtained at a storefront location or via the internet.

Yes, I'm here. I can't be here 24 hours a day, however.

Are the amounts you're listing as paid, the actual amounts you've been debited or what they're saying you've paid?

Speedy Cash, CheckCity, Cash Central and CashNetUSA are all licensed to lend in your state. You will need to work out payment arrangements with these lenders. I suggest asking for an extended payment plan as outlined by the CFSA.

The others are not licensed. You are only required to repay the amount you borrowed, no fees, no interest, etc. If you've already paid that, you're done. If you've overpaid it, they owe you a refund. If you still owe, work out an arrangement to pay them via money order or pre-paid debit card. Do NOT give them new account info.

Your first step is to close your account and open a new one. Explain to your bank that these are unlicensed lenders who are fraudulent and you need to protect your money. The bank cannot link the old account to the new one and they cannot allow anything to reopen the account. Talk to the branch manager and explain your situation.

You need to send letters to the unlicensed lenders telling them your contract is void and you will only repay the principal amount due. You need to revoke ACH authorization and any wage assignment you may have signed. You need to give your bank and your payroll department a copy of these letters.

You'll get harassing phone calls but, eventually, you'll be free of it.

Thank you for your help. 247greenstreet has a 351 hold on my checking account right now. Should I just tell my bank that this is not an authorized charge? I know that I'll get harassing calls, I'm pretty thick skinned. I appericiate your help.

Yep. Tell the bank you did not authorize them to take anything above the original amount owed. You'll have to sign an affidavit regarding the fraudulent activity in order for it to be reversed.

Just so everyone know, be careful of speedycash. I had payment arrangements set up with them for 117 a month. Well they took at 351.00 out of my account without my authorization and used my debit card so there is nothing I can do about it. BE CAREFUL

That's precisely why we always advise to 1) close your account and 2) pay only with a pre-paid debit card or money order.
