Got a phone call from both today and gave them the spill on payday loans being illegal in NC. They stated they are going to turn it over to a third party collection agency. I told them to be sure to let them know it was illegal when they did it. The one from MTE hung up on me. What do I do next? HELP!!

Hey, I talked to someone from the AG's office a couple of weeks ago and he said that they can't do anything to you. It's an illegal debt and therefore they can't collect on it. They're not going to try to take you to court or anything because they'd be the ones getting into trouble. I would say just don't worry about it, and when the 'collection agency' contacts you, just tell them it's an illegal debt that cannot be collected on. Just let them know that you're informed of your rights. They prey on the uninformed.

When the third part contacts you if they do, send them a debt validation letter and within the letter ask them to prove that the loan was legal in NC. They will go away.

Yes, send them a dv letter as Frogpatch advises; a lot of these places back off when they realize you are informed of the law and your consumer rights. Another thing you could do with the collection agencies if they harrass you over the phone constantly is to send them a cease and desist letter as well, letting them know you want all contact to be done in writing (that way you have more documentation for yourself as well).

Honey, Web Pay Day and MTE Financial aren't even licensed to do business in their own state, let alone your state. They are completely illegal. They will threaten you, they will send you emails, they will demand money, etc. They are not legal. Next time they contact you, ask them for the license number they are doing business under. They will hang up. I got a refund from Web Pay Day. They know they're wrong. MTE is a different story. They'll play with your head until you're ready to drop. However, just know that no matter what they tell you, you will be fine. They are not licensed/legal lenders. So any "collector" they send you to can kiss your butt. Sorry. I'm a little blunt here.
