i took out an internet payday loan with payday-loan-yes. are they legal in california? i got 2 messages saying that i have commited check fraud and that they are trying to serve a summons to appear in court but cannot reach me and may go to my place of employment. they told me to call 877-231-2175. i called and i believe that they are the bam group? anyway they said they were a legal firm and that if i did not pay 800.00 something plus legal fees i would go to court. i told them i would pay the original loan amt of 350.00 and nothing more but it would have to be on my payday. they would not accept and said i would go to court that it was a civil case. can they do this. i live in california and where is payday-loan-yes located?

NO, they are not legal anywhere! They aren't even located in the U.S.

I have the same problem with these people calling from 877-231-2175. What can I do? There is nothing filled in the court system for me at this time?

they will not file in the court system because they are not legal. is your bank account secure? how much was borrowed and paid back? did you check out the sticky that shazzers posted? the steps are there to help you. read it over and let us know if you have any more questions.

I took out too many payday loans in the fall, couldn't pay them back, closed a bank account because of fraudelent use, then contacted all of those I had loans with, making payment arrangements. I received a call today from a gentleman who said he was the legal dept of Insta Cash, 408-689-0448 and that he was going to take me to court, tomorrow if I didn't pay $1050.00. I asked him who InstaCash was and he said it could be one of hundred's, if I didn't want to cooperate, then good luck in court. I asked if I could have something in writing, he said no, he wasn't authorized. He also said the call was being recorded and the courts could have access. Then he asked me to write an apology letter to him, have it notorized, fax it with a $300.00 pyt and he would accept payt. I asked him for a Letter of Collection, he became irate, said no and that if I didn't fax the letter, he'd see me in court. Does this sound right?

NO!!! He is full of crap! You would need to have received a summons before any appearance before a judge. Stick to your guns, tell him to send a dunning letter and proof you owe the debt, then MAYBE you'll talk. Until then, tell him to piss up a rope (or something to that effect lol).

The same thing happen to me except I did send them a letter and money but soon after I realized it was a scam and closed my account and filed a fraud claim. I got my money back and now they are calling again. It is a man with a Indian accent he has used names like Sam -Mark- Adam He called from various number and all of them have complaints so please be aware and just ignore them or play with them like my husband does and argues with them and tells them his lawyer said to provide a letter stating we owe this loan and inlcude the loan company name he usually backs off after cursing my husband out.

I told a similar caller "Mark" that I had read all about the scams with his company online and that the US Attorney General's office has been notified and that I would like his name for the report. He hung up, have not received any calls since.

A-holes.

I as well am receiving calls at all hours, threatening me with jail. The caller states that they are an attorney that is filing charges with the district attorney's office for check fraud. They said that I took out several loans with their company online, the money was deposited and that they were unable to collect from my account because I closed it. I did close my account. I did apply for a loan but was denied. There were several attempts on my acct. to withdraw money and it caused my acct. to be overdrawn almost $400. The bank officer suggested that I close my acct. and re-established a new one. I just got an email from them stating it was from the "USA Attorney's Office" that they were going to be sending my case file for prosecution that that it would cost me "$10,000. and long period of jail time". Has anyone gone to jail over jail time? I lived in California when this began some 5yrs. ago. Now I live in Arizona.

nobody has gone to jail for a pdl.especially an illegal internet like paydayloan yes.so don't fret as any threat should be treated as illegal.
