Question(s) on Illinois Internet Pay Day Loans
I have the following loans, all obtained on line.
PAYDAY ONE-, SALARY FAST.COM , CASH NET USA, MAGNUM. I am going through a Debt Solutions Company to pay these. They are extremely reputable and has helped me in the past. I was stupid and desperate. I do have a couple of questions. 1. What are these letters people keep referring to to send these internet loan companies to stop them from adding additional charges and interest? One is a CD letter and then there is another one (can't remember the names) 2.What do fellow posters mean when they say these companies are not legal in Illinois, especially if they are obtained on the internet? 3.)Can these internet loan companies garnish wages? 4.) What can I do if these companies turn me over to collection and/or garnish my wages? Your help and responses would be greatly appreciated.

I believe that Payday One and CashNetUSA are both legal lenders in your state, it might be in your best interest to look over their contracts, perhaps they were acting as installment lenders, they have been known to do that. The other two lenders, Salaryfast and Magnum are not licensed to lend in the state of Illinois, this means when they lent you money they broke the law, I have my doubts that they will work with any debt relief company because they aren't operating legally. It would be in your best interest to close out your personal account as it will never be safe again as long as these companies know your account number. Asking your financial institution to block them won't help because they will change their names and debit your account anyways. It may not be right away, but they WILL withdraw from your account as long as they know your account information.
What most of these Internet lenders will do is have you agree in their contracts for them to envoke a wage assignment if you should default on the loan, a wage assignmrnt id different than a garnishment, but luckily the federal law says that you can revoke their rights to envoke a wage assignment, however, you need to send them an email revoking their rights to a wage assignment, then print it out and show it to your employer. Companies need to follow state guidelines in order to do business in it. Certain companies might not abide by these standards and therefore are declared illegal in the state. You can read the state requirements for internet lenders in the following link. Search for your state's name to read the requisites.
http://www.debtconsolidationcare.com...-50states.html Now, if the particular lender isn't licensed by the state, it means it's operating illegally in your state. An illegal lender can neither report to the credit bureaus, nor they can garnish wage (if it's at all permissible in IL). Moreover, the illegal lenders can't seek recovery for interests and charges and as a debtor you're obligated to repay only the amount you have borrowed from them. Hope I'm able to clear your doubts.
