Pay day loan debt

mc...did you close your checking account while you filed with the BBB? I have overpaid on 3 PDLs and have to close my checking account and ask for refunds? What process did you use?

I followed the advice of everyone here, but I did not close my checking account. I put a hard ACH block on it. It really makes it hard, becuase that means no checks electriconical either, which where I live all utiltities, & most stores process that way. But I went thru my bank account and wrote done all loans with who and amounts borrowed to what was taken out of my account. I then faxed each company a letter that i got from here, put my state information in it and filed complaints with AG's office, Indiana Dept of Financial Inst. and the better business where each is located. The first one that sent me pif letter I still owed them $20. The loan shop just sent me email me telling me the have approved a refund and my account will be closed. I asked for pif letter but I have saved every thing they have sent me. They said I should have my refund Tuesday we will see.

ok...i appreciate it. How long do you have to keep the hard block on your account? can you still write paper checks? and does direct deposit still work? sorry about all the questions, I just dont want to give them anymore money if I dont have to. thaks

No problem glad I can help, since everyone has helped me. Yes, I can still write paper checks as long as they do not go thru electronically, like Wal-Mart, where you sign that paper and they give you-your check back. This check with an ACH block on your account will be sent back by bank... I just put the hard block on about 1 month ago. Yes direct deposit sill works, go and check with your bank on the ACH though, I explained to them my problem and wanted to make sure I was not going to have any issues with this. I also asked about the pdl sending thru paper checks I check my account everyday, so if I find one I must call asap and they will send it back. I may have to take copy of letter to them showing where I have revoked this from that company,but it will be worth it. The only company I am truly having any trouble with is GFS or GFSIL. The others I am waiting on my first call from. I just received an email from Geneva Roth Corp or GRC Funding so I resent my letter to them I over paid them by over $700. I just received my pif letter from the loan shop in the last 10 mins.

ok..sounds like a plan to me. I have three out that I have overpaid...I just dont want to give them any more than I have to

Hey got my refund from Loan Shop.... Now need a little help. I have an installment loan with Check N Go First Bank of Delaware. I know it is legal I believe and I have yet to make first payment. They got hit in my ach hard debit. Need to set up payment arrangements with them but they say either money gram or debit/credit card. won't take my moneyorders. Anyone have any advice on this. I have read some of the other post, but need some more help on this. Thanks for all you have done so far.... you guys have been a big help.

You can get a prepaid debit card for the amount of your payment. That way nine of your info gets out.

I got a call from paycheck today yesterday telling me they were going to turn me in for check fraud. Told the lady when she can validate the debt. I will pay. I owe them the full balance of $200 plus interest per state of indiana, she got mad and hung up. Today I get an email from them stating that my payment was returned and that they had tried calling me and emailing me with no success.. I emailed them back telling them that was not true I had just spoke with them yesterday and I re-emailed them my letter to them and told them I would be making money order payments if they wanted their money that is how they were going to get it. emailed me back that they only accept cc, debit card, money gram or checking account, told them they would only get money order from me and again resent my letter. They then emailed me again saying they were going to turn me over to a 3rd party collection, i emailed her back stating go ahead and to remember if they report an illegal loan on my credit i would have to contact my attorney to file suit. and that I have already contacted teh bbb, ag, indiana dept of financial inst. and my next step was the ftc. she then emailed me back with do what you want just remember when we loaned you the money we did not write you a check. I responed with that i understood that but you are not licensed in IN Or OK just remember that and her next response was to stop emailing her unless i was making payment arrangements. Sorry had to laugh at that one. I really want to thank you guys, I am alot happier that my paychecks are actually mine. I'm not as worried as before. You guys are turly the greatest.

mcc, great attitude! You're doing the right thing. If they want their $200, they can take payment another way. Hell if you give them your bank account/credit card info! I personally hold out for a physical address to mail payment to. However, this illegal idiot pdl will most likely never give you a "real" address to mail payment to. That's why they want the payments made the way they stated (credit card/checking/etc). They're not going to give you a "real" mailing address. Hold off until they can cough one up. Illegal, illegal, illegal. You keep sticking to your guns! Wink

I really laugh about this. I feel bad, because I did borrow the money, but then I read all the post from everyone and keep thinking how many people they are stealing from and I know from experience how broke I was until I found you guys. I actually have taken control of my money again, besides getting caught up on other house hold bills. The girls I work with are helpful too, when GFSIL calls they just pass them around to each other until they hang up. When they call my extension, I tell them to sue me if they can't give me an address to send payment to, but remind them they can't sue me when they can't even validate the debt. My life is actually a little easier now.

Anyone ever deal with Checkngo / first bank of delaware. since they are going under a bank, can they make me use my checking account. so i call and speak the bank or with checkngo. I am about to default on this one, because i had to put hard block on my account. just wondering if anyone has dealt with them.

mc, it is my understanding you can revoke debit authorization - period. So, they can take alternative payment method from you. I know there are many members here who have the same First Bank of Delaware installment loan who have closed their bank accounts. You'll just have to contact them and make another form of payment. If at all possible, see if you can do money orders. This is soooo much cheaper. Or you can use a pre-paid debit card if they push you. Money Gram and Western Union cost way to much. Call and tell them you're not paying with debits any longer. Ask for an address to send money orders to. If they give you grief or say they need a "credit card", get a pre-paid card and only put the exact amount on that card and give them that as your credit card information.

Thanks for the info. I have finally heard from Geneva Roth. They are willing to mark my account pif, but don't want to refund me the $700 i have over paid. I said I expect a refund, I just told Joel that since they are licensed in Utah they have to follow Utah guidelines and this should of been paid off in 12 weeks from date I took out. And they are not supposed to lend to people in Indiana. He said since I looked them up, they can lend to me, I said no sorry. I have had other payday loan companies say they can't becuase they are not lic in indiana so they can't help me. Told him i had already complained to BBB of Utah, Indiana Dept of FI and State Attorney General Office my next step was FTC. He said he has spoken with his companies attornies about this and they don't feel they owe me a refund, and they know the laws. Told him they need to review Utah's becuase he acted like he didn't know about the 12 weeks. wanted to know where I got info, told him State of Utah. changed his tune real quick.
