Ashland Funding.. Misrepresented?

When you originally took out this loan did you print out the loan documents that clearly state their name and phone number? On this document it states your acct # your pay off due date and the scheduled refinance date and amount due? Also on this form on the bottom it states if you are not accepting the option to refinance you must fax or call them 3 full business days ahead of the loan date. Sorry It sounds like you took the money and ran without reading the fine print.

guest, I wouldn't have posted my email address if I were you. Not a good idea. Especially when you're making negative comments regarding issues you're not fully aware of.

So get this.. after Churchill calls my place of work MULTIPLE times, attempting to contact me, they THEN call my cell phone number they have on profile. At first i wouldnt answer until i had my battle plan. I finally talked to a lady who barely spoke english who told me that they wanted 340 dollars to "settle" my 200 dollar pdl. HA! not only have they taken well over the principle amount, but they have the audacity to raise my amount. Now if im not mistaken, as part of what a collection agency can and cant do, arent they only permitted to collect the principle amount? technically this company has no right to charge me fees for a balance that wasnt even taken from them to begin with. So after arguing with the lady i spoke with she transferred me to her "supervisor" who gave me an even HIGHER settlement amount.. trying to play it off as him doing me a favor. I told him i disagree with owing all this and told him to send me a detailed proof in writing which is my right by law. He says "Um, yah, well, i have to tell you i can do that but it'll take 30 days to be mailed out and the fees between now and then are going to go up." Basically threatening me. So i told him to send it, and ill take it to court. Two days later HIS "supervisor" leaves me a message saying i have to get online and fill out a release form to get that info in writing. So ive closed my account and opened a new one. Theyre not getting a dime, and i HOPE they ding my credit for it.. cuz im just dying to unleash the hell that is my rage at whats happened over the last months with them. So ill let you know what happens from here, and hopefully that'll give you all a clue into what you can get away with and whether or not theyre legal. My guess? not a chance.

nk9, did you receive anything in the mail from Churchill? A "statement" saying you owe suchandsuch amount for suchandsuch loan? Anything? Because I've received a letter from a collection agency (illegal company) that demands $200 over the principle amount of the loan that I overpaid anyway. However, it states on there that you have 30 days to request a debt validation in writing to them. Did they send you anything? If not, you could always go ahead (since you have their address), send a debt validation letter to them. Let them validate that debt. That would be very interesting to see. This way, since it was just a phone call (no documentation) and he is going to take 30 days to get you some information (what???), you can take the first step. In your letter, refer to the phone call (documentation) and then ask them for debt validation. Keep a copy of that letter. Send them the letter certified mail. You will be one step ahead of them.

I was so happy Very Happy to see that I am NOT the only person having problems getting hold of these people. Unfortunately, I've been dealing with this much longer. I've thought about putting a stop payment on them, which now I've decided to. I am so glad that when I punched in "Ashland Funding" on google, I've got your posting. I have never gotten any paperwork from them electronically nor via the fax. Twisted Evil

I hope a lot of other people read this and see that this is a problem and others need to be aware.

Thanks, again!

I received a letter from a company called First Credit Services Inc. stating that they r a collection agency and that I owe Ashland Funding $490. The PDL was for 200 and 60 was paid on it. I have tried to contact Ashland Funding using the number they gave me when I took the loan and can not get ahold of anyone and I even left messages asking them to return the call which they have not. They haven't tried to contact me via phone or mail. It hasn't even been a month since I paid the $60 and already they have turned it over to someone else. I not sure exactly how legal this is, but I did do some research on FSC and I don't think they are legit. If anyone can help let me know Smile
