I am currently having the same problem all of you are having about Kristin Swanson Mace. This company called today claiming that they were going to take me to court over a PDL. They said that they sent me information in the mail back in January about this debt. I keep all my mail in a filing cabinet. I have never received information from this company. They told my husband that I was a liar and that they were going to charge me with fraud and send me to prison over a $300 loan. Mind you, this company was also calling my last employer and that is the reason why I lost my job. The lady that I have been dealing with is named Sherry and her extension is x325. Does anyone know how to find out if Kristen Swanson Mace is able to practice law in Washington state?

I don't know if they're able to practice law in Washington State. As I said in my earlier post, I'm in Maryland and I'm working with our State office of financial regulation. They got in touch w/ Kristen Swanson Mace, sent them a letter and hopefully "that is that." You might want to contact the financial regulatory offices for Washington State, they might be able to help you out. Good luck!

they are 1) not licensed to practice in washington state, 2) not licensed to collect in washington state 3) made illegal threats. try this text:
In accordance with the Fair Debt Collection Practice Act, ยง1692g, I hereby request that
you validate this debt. The act provides that you shall cease collection of the debt, or any
disputed portion thereof, until you obtain verification in accordance with the law. That
verification must be in writing, contain the name and address of the original creditor and supporting evidence of the alleged debt. Included in this evidence shall be documentation that the alleged debt was incurred in accordance with Chapter 208-630 Washington Administrative Code governing payday lenders.
Please be advised that as previously transmitted to your client, the was initiated in violation of Washington State Administrative codes governing Check Cashers/Sellers and Payday Lenders (Chapter 208-630 WAC Check cashers and sellers - regulation of), wherein it states that payday lenders are required to be licensed by the State of Washington. This law applies to any payday loans made to Washington State Residents regardless of the state of origin or contractual jurisdiction agreements. Because you were conducting payday lending business in violation of this administrative code and the governing law directing its creation. This violation renders our contract illegal in the State of Washington, rendering any terms agreed to therein null and void. Additionally, Washington Law holds that such transaction shall be unenforceable and uncollectible. Further both you and your client attempted collection using illegal threats violating FDIC and fdcpa rules. These violations are being reported to appropriate regulatory agencies in Washington State.
Your are hereby admonished cease all communication except for written correspondence. You may contact me in writing at the following address:
Further violations of law will be addressed in either federal or state courts as appropriate.

basically they appear to be another CA that uses the name of a legit attorney (in florida). However, they are only CA in Washington and not licensed at that, meaning there is nothing they can legally do in Washington state

I received several calls from this office..I decided to look for them online and clicked on this site..glad I did..
I do not understand all of this stuff..what is a PDL? I am 62 and in bad health on SSI..I had some problems with credit due to someone I lived with in NJ but have not heard from anyone about these ten year debts for about a year..last people I heard from was a collection agency in NY and they kept threatening me..I called my bank and talked to the lawyers there as this company threatened to put a hold on my bank account but in Calif you have to have a balance of 2000.00 or more each month. So I learned a few things and also learned they were not allowed to threaten you in Calif on the phone..so I told them that and was told see you in court..never heard from them again..so I am assuming this is the same place that is calling me..the Swanson and Mace..they left a number and even called one of my daughters who does not live here with me and left a message for me to call them on her phone at home..
I don't know what our laws are here in Calif. What should I do..any help would be very much appreciated..

that would be a debt validation letter my friend.it is your right to request or demand that the CA give proof that they have legal rights to collect.

Dolfyn311, a PDL is a payday loan, a short-term loan. Sometimes these collection people are bogus and will go after people who've paid off a PDL years ago! As far as California laws, if you do a search on this site, I'm sure you'll find your state laws. Or there's other people here more knowledgeable than I who can help. If these people call you or your daughter again, I'd ask them to send something in writing on company letterhead stating exactly what you owe and the origin, etc., of your debt. Then see what they say to that.
