Yesterday evening I got a recorded message on my home phone from the Law office of Kristin Swanson Mace; they also left a voicemail message on my work phone # yesterday evening after I'd gone home for the day. The message stated "we've tried to contact you several times and you haven't called us back," something like that. Well - considering this was the first call I received from them, it's hardly surprising, huh? Anyhow - I "googled" their # and also did a search at this site, and it appears there IS such a firm in Florida. I'm betting it's w/ a PDL - has anyone else had dealings with these people? (I'm going to try to contact them again today and also refer their # to the person at Maryland Financial Regulation, Enforcement Div., who's helping me w/ my PDL's.)

Is it actually HER leaving the message OR is it 'computerized' message and a phone number to call back? I've gotten a few 'computerized' ones. Such a pain. The message doesn't even state who's calling or why..just a phone number to call back.

First of all make a call them and ask them the reason for which they have called. Please don’t speculate and don’t give them the impression that you have any idea about the reason of their calling.
Please tell us what they have said. Only then we will be able to answer your query.

I answered my phone last night and the recording said: "this is a courtesy call from Swanson Mace; we have tried repeatedly to reach you with no success," and they left a phone #. No message as to what it was about. The recording played several times and tied up my phone. When it finally hung up, I tried calling and got another recording saying their mailbox was full. When I checked my voicemail messages at work this morning, I got their same recording. I'm going to try and call later and find out who they are and what they want. Since I've had PDL's , that's what I figured it was about, possibly a collection for a PDL? I'm not involved in anything that would involve law offices calling me. (that I'm aware of!!) No fear, when I call, I'll just give them my name and ask why they called, I won't give any other personal information. As I said in my first post, I googled them, and it sounds like they might be a scam. I was wondering if anyone else here had heard from these people re PDLs?

Thanks, Roadwarrior! I called them this morning, and it IS regarding a PDL. I asked them the name of the PDL, they said "Payday Loan Company!" I told the man I was working w/ the State of MD, and in MD PDl's were illegal. Then I asked if his firm was licensed to collect in Maryland; he said yes. Then I asked if he'd send me something in writing on company letterhead to that effect. He said they didn't have to, as they WEREN'T a collection agency!! I repeated my request and he transferred me to someone else; I gave her the same request for a written letter, she said they didn't have to, as they'd been retained as a processor to move the companys' claim against me through the clerical courts. She said internet PDL's weren't illegal in Maryland, I said the State of MD said they were. She then asked if that meant I wasn't paying any more towards the PDL, I said that was correct. THEN she informed me after the fact that our conversation was being recorded and I should get an attorney and hung up. Goes without saying I've faxed a report of this conversation to the State of Maryland, will see what they say. Golly, ain't PDL's fun? Very Happy

I can only comment on my experience but I have had many phone calls from Kristin Swanson Maze. They threatened everything even jail. That is a clear sign they do not know what they are talking about. I believe this is one of those lawyers who has "rented" their name to a collector for PDLs. I am in Kentucky and I was advised by the Office of Financial Institutions in KY that this is an illegal debt and to just not take their calls. If you do take their calls they will get very ugly, very threatening. They even told me I was due in court at 1 p.m. one day. When I asked which court he said the court in Kentucky, you know which one. I quit taking their calls and they have quit calling.

Thanks for the info, motomom716; Yeah, that was the impression I got, they didn't know what they were talking about. One minute they ARE collecting "for a PDL," the next minute, when I asked for something in writing, they're not collecting, just processing the claim in the courts.... And I asked for written verification of what they were doing, and they wouldn't send it; no excuses, just "they didn't have to." Wouldn't any legitimate organization be more than willing to back up their claims in writing? These people are unreal; just wish I knew WHICH PDL they were calling for, but that's what they said, the name of the company they were representing was "Payday Loan Company."

I recently started getting calls again from a 'Burgess' fellow ( or shall i say his 'secretary'). The wonderful "Law Office Of (can't remember first name ) Burgess". When this 'law office' called before, I looked them uo on the BBB site and some OTHER things. BOY!!.did I find alot of crap on this 'office' (Fraud, Theft, etc.). SOOO.....when the office called, and I answered the phone, I asked to send me something in writing, about their 'claim'. Can ya guess what they said? "They were not obligated." The number they were calling from was a number in Canada..what the heck?!

The State of MD has been in contact w/ Kristin Swanson Mace on my behalf, and was given a royal runaround, too. They won't tell who they're working for, they just say "Payday Loan Company." Personally speaking, seeing as I haven't heard from good ol' United Cash loans for a few days (knock wood!), I'm betting it's someone who sits 3 cubicles down from the UCL call desk! If it IS a legit law office, unless they're licensed to practice in Maryland, they're outta luck.

Anyhow - it's been mentioned on this thread and others that law offices "rent" their names out to collections; does anyone know exactly how that works? Is it actually legal? Or, since companies such as United Cash Loans are operating off of Indian reservations and are exempt from many laws, is that how they're able to use a law offices' name? Just curious...

"Phillyburbs," I take it from your name you're in PA? PDL's are prohibited there too, right? If you're asking about United Cash Loans, unfortunately it apparently Kristin Swanson Mace wasn't working on their behalf, as I'm still getting calls from UCL. When they call, as soon as they identify themselves, I say goodbye and hang up. Hey, I can keep hanging up as long as they keep calling. Who's been calling you about getting filed w/ the county court house? If it's United Cash loans, I rather doubt they can do that, as they're illegal just about everywhere. If you're getting calls from Kristin Swanson Mace, you might try checking with your States' Financial Regulation agency, as I did, that might help.

The also have been known to work with epdaydayloan. Since they have contacted you and clearly attempting to collect a debt they are considered collectors by the FDCPA. If your state requires that attorneys who file suit be licensed in your state, and they are not then they are also practicing law without a license in yuor state in addition to violating the FDCPA. Send them a validation letter then wait for their response.. my guess is you wont get one.. also note on the letter when they first called you and if you received anything in writing from them within five days.. again as required by the FDCPA..
