AIS/Legal Mediation/Cash Supply

PostPosted: Wed Aug 29, 2007 10:43 am Subject: AIS/Legal Mediation/Cash Supply

So, legal mediation is owned by a company called AIS. I have credit monitoring so I saw that AIS placed a collection on my credit report. I called the number and found that Cash Supply listed my account with legal mediation. Well, Cash Supply is listed on my dmp, and we sent them money. They recieved the first payment. But, now my DMP and AIS services needs Legal Mediation to acknowledge that they own the debt and then payments will be re-routed to them. I sent a debt validation to Legal Mediation already. And, I filed compliants with my state, for their harassing collection techniques, and now I have to call them to get them to fax me something that shows that they own the debt?!?!?!? SOMEONE HELP!!

Also, they reported this debt on my credit report without properly validating the debt first. When I spoke to AIS they said that they could do this. Can I dispute this filing? I'm afraid that since Cash Supply doesn't own the debt anymore, they are taking my money and running with it!!!

Debtfree08, love the name. Here's to it coming true for you!

Quote:
If a creditor can't verify a debt:

"They are not allowed to collect the debt,
They are not allowed to contact you about the debt, and they are also not allowed to report it under the Fair Credit Reporting Act (FCRA). Doing so is a violation of the FCRA, and the FCRA states that you can sue for $1,000 in damages for any violation of the Act.

The opinion letter from the FTC which clearly spells out that a collection agency CANNOT report a debt to the credit bureaus which has not been validated:

http://www.ftc.gov/os/statutes/fdcpa/letters/cass.htm

It also states that you can sue in federal or state court. So if you have them on a violation, then you have damages of $1,000 for the incident plus damages. Small claims court, anyone?"

I'm not a lawyer, but it looks like to me that if requested debt validation, and they didn't validate but reported this to your credit bureau, then you can sue them. You can dispute this with the bureaus also. If they don't change it, you can sue them also. Once again, not a lawyer, so I'd check out the fdcpa and the FCRA.

Good luck!

Hi Sub!
Thanks for your help. AIS did send me back the original loan documents from Cash Supply, but nothing else. I did not pay anything on this loan, but I have been through my dmp. What should I do now? Send a letter to Experian?
