I have an account with the Loan Shop.
I sent them a C&D letter back on the 9th
of Dec. I received an e-mail stating that as of the 20th of Dec, that my
account with The Loan Shop was paid in full.Since then they continue to debit my old bank account that remains open due to it being nsf.I have filed complaints with the fraud division
to attempt a reversal of charges.Can or
should I file a complaint with the Florida AG? If they sent me a PIF
shouldn't they have stopped debiting my
account?

I'd file a complaint with the AG, the BBB and the Florida Office Of Financial Regulation. Have you tried calling the Office of Financial Regulation? (850)410-9805
I'd also show the bank branch manager a copy of the PIF email and tell them you are also making a complaint against them if they will not stop the ACH's.

I think that the advise the lonegunman gave you is excellent. I would show your branch manager that paid in full letter and that they are illegally debiting your account. I would think that your bank could cease this activity and refund your nsf charges.
It shouldn't matter if they sent you a pif because they are still debiting your account and you need to complain to everyone, every office everywhere to anyone that will listen to you.

Thank you lonegunman and ladybug I just downloaded a
complaint form from Fla Office of finance & regulation
I'll be sending the complaint out asap.I will get to
my bank tomorrow and continue this fight there with
them.Thanks again for your wonderful help.

Stevekathy4867 did you contact The Loan Shop about these continued debits? I'm asking because I too received a debit after my refund settlement. I contacted The Loan Shop and they claimed it was a mistake. They said it happened because their collection department did not read the note that the account was paid in full. They offered to pay me back for any NSF fees. I only had one resulting from that debit and it was promptly refunded.
Follow the other advice, but make sure you contact The Loan Shop. If you let them know you know what they're doing, they may play it off, as they did with me (I don't believe it was a mistake) and refund those charges.

Thanks to all for the advice,I have been typing all
afternoon.I typed out a letter to loan shop detailing
the amount that they have been debiting my account
sort of like a C&D letter but also informing them
of my additional complaints with the AG,BBB and my
bank.I sent it out certified return receipt.
The reson for the letter is I have tried in vein to
talk to anyone at there customer service.I even tried
to talk to a loan representative but put me on terminal hold.I also left numerous voice mails with
their customer service manager who sent me the PIF
letter initially.

Stevekathy4867 that's great. At least they can't say they did not get it. Did you ever get an email address from them? You might want to send the letter email too. You can try these email addresses:

These are the people that worked with me. I don't know if you will get a good result with them but, its worth a try.

Annie, this is why in your post I brought up about closing your account, even though they said yours was PIF, do not trust these people.

I know LoneGunman I don't trust them. I did try to close the account. The bank representative assured me it would be closed by the end of the day but, it wasn't. That's how the debit got through. The Loan Shop did credit back the NSF charge but, I will make sure this account gets closed.
Actually LoneGunman I don't even trust banks anymore. I think I'll start advocating for hiding money under the mattress or a coffee can.

annie, I agree, I don't trust the banks either, they make a killing on NSF fees. My wife was told by our bank that they cannot stop ACH's when the law says they must.

LoneGunman I remember long ago when my parents did not have a bank account. They kept money in one of my dads jacket pockets. In those days they had lots of money. They did not have to worry about bank fees or buying checks. Sounds like a good idea to me.

Annie, I was involved in an all cash business (lol yes it was legal) a few years ago, almost paid everything with cash, the more I think about it the more I think it was a better way.

I recieved a refund for NSf fees that that this pdl
had created by continuing to run charges through my
account.I was shocked to actually recieve the money.
This is one more pdl off my behind.
