|
i have about 10 or so internet payday loans in Virginia. i've checked my states laws and determined that these loan companies are operating illegally. I have had some of these loans for over a year and at this point i am in so much debt that i've almost lost all hope. i've closed my bank account but now these companies are calling me constantly. Please help.

because of the high # of loans that i have, i do not know the exact websites that i obtained the loans from, but these are names of the companies that i have loans with (names of the companies are from my bank statements...please post name of company if you are familiar with the description):
unitedcashloans.com...borrowed $400.00; paid $945.00.
pdayserv 800-420-8023?...borrowed $500.00; paid $1,775.00
Ambassador...borrowed $500.00; paid $690.00
Route66Funding.com...borrowed $225.00; paid $455.00.
Geveva Roth...borrowed $300.00; paid $1,440.00.
SpeedyPayday.com...borrowed $1000.00; paid $1,250.00
NationalMoneyStore.com...borrowed $1000; paid $1,762.50.
WorldWideCash.com...borrowed $400; paid $1,090.00.
MyPaydayloan.com...borrowed $800.00; paid $600.00.

Nice job Marlo! I know that was a lot of info!
From what I can see you have paid the principal back on these multiple times over!
So, you say you bank account is closed? Have you send these pdl's letters letting them know not to contact you anymore and to revoke any wage assignments (just in case)? If not, I can PM you a letter to send them. Be prepared for the constant calls.....some will stop after you send them the letter, some will not.

OMG...you poor thing!! I can't believe how uch they have taken from you...this crap just makes me cry sometimes.
All are paid except your last with MTE...make sure you get and keep that bank account closed...send cease and desist letters to all of them...demand refunds from the ones you grossley overpaid!!!
You said you checked and none are licensed?? Correct??

Rollovers are not permitted in your state either...you also will need to file complaints with the BBB and your state's attiorney's office...they can help mediate resolution for you and possibly get some of that money back.

I called the pdls I overpaid and they have been more than willing to work with me. They actually gave me some of my money back.

Marlo, Be sure you do as Volleyballmom says and send (use certified mail} and e-mail and fax these pdl's letters and include the things she told you to. Also let your payroll department know about your revoking any wage assignemnts you may have signed. A couple of the companies you listed can be difficult to deal with. They have already started calling you. Try not to take the calls. Take messages for yourself it you need to. Document everthing and try to only correspond to them in writing...for documentation purposes..you can put that in your letter when you tell them not to call you. All the documentation will help you when you file. At the time you send the letter you can inform them that you overpaid and tell them you demand a refund. Biker Girl has been luckier than most. Like you I way overpaid mine (I had and I have only seen two refunds and they were for the two smaller amounts. If you have any questions or need any help, just post. As volleyballmom said, if you need a sample letter, just ask. There are several that members have shared. I really hate that you have so overpaid your loans and I hope we can help you get them resolved in your favor. roxy

Okay. Your bank account is closed. They can't debit any further. You now need to kick some butt in the letter writing department. They're going to call your head off, as the majority of these are illegal/unlicensed pld's. Okay? So, you need to write letters to each one revoking any debit authorization, any wage assignment you may have signed, only contact you via email or USPS - no phone calls. Try not to take their phone calls at all if possible. You NEED to get these letters out ASAP. Your ROUTE66 - you need to send a letter revoking wage assignment ASAP! And I mean NOW! Before they send a wage assignment to your employer. Wage assignments are strictly voluntary; however, most employers do not know this and may abide by it and take the money out of your check. So, right now, type a letter revoking any wage assignment you may have signed with them, their partners, or their affiliates. Fax it, email it, mail it certified to them NOW. Route66 will pull the "wage assignment" on you. Now, as for your loans. If they are all indeed unlicensed/illegal, you are going to have to fight the crap out of these people. Here's the breakdown IF they are unlicensed/illegal. These amounts are based upon owing the principle amount only. As, if they are unlicensed/illegal, you only need to pay back the principle amount. Are you ready?

volleyballmom, sample letters would be greatly appreciated. also, much thanks to everyone else whos taken time to respond. all of your support has been so uplifting. i cannot express how much you all have helped just by your kind words of encouragement alone. i am pretty busy at work but i am planning to get all of the letters together and mail them out asap. does anyone know addresses for any of the companies?

BikerGirl, were you able to obtain refunds from any of the companies i listed? what is my best bet to get money back from these companies? if thats not possible, does anyone know if these people are willing to accept my accounts as paid in full and just end the contract? the companies i've talked to are demanding that i pay much more than the principle (finance fees, late fees, NSF fees, etc.), but now i want to turn the tables on them and demand some of my money back. as you can imagine, the last year of my life has been completely ruined by this mess. i am still struggling just to eat regular meals lately and a refund from these companies would at least allow me to get back on my feet.

AIP will usually give refunds, but please file a complaint against them with the BBB . . . . For some reason they seem to respond really well the complaints from the BBB . . . .
The other companies are not really known for giving refunds, but it is always worth a try. If you are owed it, go for it. You can always settle for PIF . . . .
