Ok so i got a payday loan from a place in Mississippi. It was the type of loan where you post date a check for 2 weeks then come pay it back. Well I had some financial issues happen and couldn't pay it back. Then my bank closed my account because off all the overdraft fees I was incurring. They kept depositing the check and I was getting further and further behind because of it. The next thing I know, I am getting calls with them telling me I am going to jail. I really don't want to go to jail. Is that even possible?? I am just really really confused. I don't really know the Mississippi laws on this. Could this be considered writing a bad check or check fraud??? Help Please!!

No they took a post dated check to begin with. Debt is not a criminal matter it is a civil matter. If this is a store front lender they can take you to civil court and request a judgment. If this happens the judge will put you on a payment plan. Try contacting the corporate office of this lender and make payment arrangements. Dont ignore them communicate with them so they will work with you.

kfstaff is right.

From the MS state law:
Quote:
Criminal Action: Prohibited (When check returned due to NSF)
At this point work with corporate. What was the name of the PDL?

What is the name of your storefront? If they are members of the CFSA, I would report them for threats and harassment.
